husband was killed by a drunk driver who crossed the center line and hit his car head on. <br />She thought many parents she knows would be extremely upset and irate if their child <br />was harmed from consuming alcohol, the police knew it and did nothing. This proposed <br />ordinance is life saving. She urged the Councilmembers to support it. <br /> <br />There being no further speakers, the public hearing was closed. <br /> <br /> Ms. Ayala had some reservations about the urgency of the ordinance. She was <br />supportive of the parents taking hold in some manner of the responsibility. She was <br />encouraged by the discussion a couple of years ago. The 5-40 programs at the high <br />schools if a perfect place to have this discussed. She would like Councilmember <br />Campbell's input on this because of his constant contact with teen age citizens. She <br />wondered why this did not come before the liaison committee so they could have this <br />discussion with the school board members. <br /> <br /> Ms. Hosterman asked Chief Neal about a modification that would give the police <br />department the option to make the phone calls, make the contacts and take it to that step <br />for a period of time and see how this works. Would this be possible? <br /> <br /> Chief Neal said it would be possible. The urgency status was not intended <br />because of crowded council calendars and the upcoming prom party season. The <br />opportunity to intervene with one student was enough to warrant looking at this. <br />Obviously Councilmember Ayaia's point about the liaison committee looking at this is a <br />good idea. They have tried to look at all aspects and felt the involvement of the Youth <br />Commission and their review before bringing it to Council was a good point. He felt it <br />misrepresents it to look at it as a major infringement upon people's rights or a <br />Constitutional issue. The police are responding to the calls, are already inside the homes, <br />and literally, as Ms. Block from MADD stated, just give them the ability to do something <br />when you see a crisis and a tragedy waiting to happen. This is the missing link in a <br />community that cares so much about their kids and they would like to have the resources <br />and drive to do something about it. <br /> <br /> Mr. Brozosky asked if there was something else that could be tried, such as <br />calling their parents when the police go into the house. If the kids do not identify <br />themselves, then the police would have to take them in, without going to the level of the <br />fines and juvenile court. If they don't identify themselves, then there are repercussions to <br />the child. <br /> <br /> Chief Neal said there were a few problems with that. Number One, who would <br />you call? Without identifying the child, who do you call? Them is arguably more <br />infringement on people's rights when you demand they identify themselves based on no <br />statituatory authority. This is the missing link that enables the Police to be able to do <br />this, rather than asking for ID and who are these people. Not only that, but have the <br />ability to have a parent come in and pick their child up without the intent of getting a fine <br />from the people involved.
