Mr. MacDonald reiterated <br />there were extenuating circumstances, but after listening to the neighbors the problems go far~her <br />back than he was aware. <br /> <br /> Mr. Campbell suggested three phases. First, satisfy the existing conditions set forth in the <br />letter of December 7, 2001 within two months; second, he would get six months to complete <br />phase one of this application; and if he does that, then he gets a certain number of months to <br />satisfy phase two. <br /> <br /> Ms. Hosterman felt that was a good plan. She believed that once Mr. Duggan has spent <br />money on phase one, he would be highly motivated to finish the job. <br /> <br /> Mr. MacDonald cautioned that if Mr. Duggan has to spend money to complete a porch he <br />is going to tear out, he will run out of money to get to where he needs to get. He felt it was more <br />useful to spend money getting things done that would not have to be tom out later to get through <br />the project, such as fences or other pieces of the project. Staff has drafted strong conditions. <br /> <br /> Mr. Campbell felt it was important to satisfy the initial conditions first. Then there could <br />be discussion about the addition. <br /> <br />Mr. Brozosky agreed. <br /> <br /> Ms. Ayala verified that there was a contractor and asked when he would be ready to start <br />work. <br /> <br /> Mr. MacDonald did not know when work would start. There is a plan check phase. <br />Basically, Mr. Duggan has money in the bank, he has a contractor, and a plan that hopefully will <br />be approved at this meeting. He would agree with any set of reasonable conditions. He had no <br />problem with phases for the project. <br /> <br />There being no further speakers, the public hearing was closed. <br /> <br /> Mr. Roush believed all the items in the December 7, 2001 letter were addressed in the <br />conditions of approval. <br /> <br /> Ms. Ayala liked the plan for the addition. She said if Mr. Duggan has to complete <br />condition 1 of the December 2001 letter, it will not look like the new plan. She wanted to repeal <br />the approval of the addition unless he meets certain timetables and guidelines. She believed the <br />neighbors would be much happier with the new plan than just trying to bring the house up to <br />Code. <br /> <br /> Mr. Roush referred to Condition 3 of the conditions and suggested it be reworded to say <br />that if the fences are not repaired within thirty days, then the approval lapses. The same thing for <br />Condition 4; if the pier holes are not securely covered within thirty days, then the approval <br />lapses.
