neighborhood. The fastest way to make the Duggan house look like a home is to force him to do <br />what he was required to do on December 7, 2001. It was implied by Mr. MacDonald that it is a <br />matter of Mr. Duggan's family moving in. Mr. Mannion said he had coached and taught two of <br />the Duggan children at Foothill High School and felt he had a good relationship with them. He <br />did not feel he was denying them a place to live. This is a four bedroom house as it is. He asked <br />Council to help the neighbors in this situation and to deny the request. <br /> <br /> Ron Potter, 3541 Kings Canyon Court, said he has lived in this neighborhood for thirteen <br />years and all that time the Duggan house has been in various stages of construction. He felt Mr. <br />Duggan's application should be denied. His history has indicated he is incapable of doing the <br />job. Mr. MacDonald related the problems Mr. Duggan has had, but Mr. Potter doubted those <br />problems were evident for the entire thirteen years. None of his projects have been completed. <br />The neighbors have attended many meetings and Mr. Duggan has never appeared. He reiterated <br />comments about Duggan having no relationship with the neighbors. Mr. Potter said he and his <br />neighbors are all busy people and Mr. Duggan is wasting everyone's time. He has been given <br />permits and given conditions. He has never met the conditions. He suggested the entire project <br />be denied. The neighbors have been patient and followed the correct channels. He has not. The <br />problem has not been resolved. As far as his children having a place to live; right now they live <br />with his mother. The existing house is 2,200 sq. fi. He related the unsafe conditions of the <br />house in its present condition. <br /> <br /> Mayor Pico felt the City did not have great administrative remedies to force Mr. Duggan <br />to fix his home and if the application is denied, it may be months or years before the property <br />could be corrected. <br /> <br /> Mr. Potter said he has been dealing with this for thirteen years. The house is an eyesore <br />and the owner is not a neighbor whatsoever. He has been given every opportunity and he refuses <br />to meet the conditions. Why continue to give him more chances? <br /> <br /> Elizabeth Rajs, 3533 Kings Canyon Court, said the neighbors have already made most of <br />her points. She has lived on this block eight and a half years and would like to have the Duggan <br />house match the rest of the neighborhood. This is a nice neighborhood. She hoped that Council <br />would be able to put some teeth into these conditions. She felt the conditions, as written, are too <br />open to interpretation. One states "if the current application is approved, staffhopes that the <br />applicant will follow through and complete the additions in a timely manner." She believed the <br />Council could do more than hope. How does the city define "timely". She has seen no progress <br />in eight and a half years and that is not "timely". Condition 7 referred to "diligently pursued" <br />and asked how that is defined? Mr. Duggan tipped out the porch three years ago. The City tried <br />to change the color of beige on a house and yet this neighborhood has a house with no windows, <br />no pomh, and poor landscaping. It seems the City should be able to do something. If Council <br />decides to approve the permits, put some weight behind the conditions, not hope. <br /> <br /> Mr. MacDonald said he had reviewed the staff report, spoken to Mr. Duggan and to his <br />contractor and was happy with the conditions. They are stronger than what is normally seen for <br />a project. He felt the situation will only get worse if Mr. Duggan is not allowed to go forward. <br />He has a contractor and financing and is ready to proceed.
