7. MATTERS INITIATED BY COUNCIL <br /> <br /> Ms. Dennis wanted to investigate the issues surrounding Neal School. She was <br />concerned and felt the District could be moving more expeditiously. She asked the Liaison <br />Committee to seek further information. <br /> <br /> Mayor Pico wanted an outline of the City's issues with existing agreements and whether <br />there are any areas where the agreements could be perceived as breached. In what areas is the <br />City's input required? He wanted an overall summary of the City's legal positions with respect <br />to the building of Neai School and the implementation or exercise of the developer fee <br />agreement. <br /> <br /> Ms. Dennis indicated the homeowners were required to pay the school fee in order to get <br />a building peardt. She felt that puts the City in the middle of this. The fee was a contribution to <br />capital costs for something that was on the list. She was eeaain it was Council's intention that <br />Neal School would be built. The City required them to pay for that if they built a home in Ruby <br />Hill. She believed the Council had an obligation to work with those homeowners to see if there <br />was something the City could do. The City would not say pay for it and then back off from <br />providing what people had pay the fee for in the first place. She realized the School District had <br />some prerogatives here, but she wanted that more clearly delineated. <br /> <br />Mayor Pieo said it was not certain that the District would not build the school. <br /> <br /> Mr. Campbell said as elected officials Council needs to respect the School Board <br />decisions for whatever reasons they made. Whether Council agrees or not is not the issue. It is <br />their decision to make. He preferred to investigate the City's responsibilities under the <br />agreements. He did not want to question the decision of the School Board. Even though fees are <br />being paid, those fees go to the School District and it can use them however they see fit. He did <br />not think the fees were allocated to a specific use like the Neai School. <br /> <br /> Ms. Michelotti acknowledged that it is within the purview of the School Board to decide <br />to take the financial risk for building a new school. <br /> <br /> Ms. Ayaia said the City is part of this agreement. She was opposed to the amendment to <br />the agreement in 2001 because the infrastructure for Vineyard was not in place. Since that time <br />the City and District have agreed to install the infxastmcture and advance the costs for it in order <br />to get the school built. All the actions have been in order to get the school. <br /> <br /> Mayor Pico wanted an agenda item to understand in what areas the City has an impact <br />and what the City's rights under the contracts and agreements are and whether Council wants to <br />take any further action. <br /> <br /> Ms. Michelotti said the District took an action. The Liaison Committee regularly reviews <br />issues and there could be a dialogue in that venue. She urged discussing this openly.
