residential neighborhood. The parking lot for the Marque is unbuffered except for the few <br />spaces on the other side of the building. Staff does not believe the parking lot noise can be <br />adequately resolved by implementing reasonable requirements if the existing business plan of the <br />dance club/bar continues. <br /> <br />Ms. Ayala asked staff to review what the requirements of a conditional use permit means. <br /> <br /> Mr. Swift responded that uses allowed as a conditional use are those that requires <br />Planning Commission approval before the use is allowed to operate. The city has an opportunity <br />to add reasonable conditions of approval which would minimize any potential impacts of the <br />business on adjoining business or neighbors. The process also allows the city to suspend or <br />revoke a permit when that use cannot be found to be compatible with the general health, safety <br />and welfare of the surrounding neighborhood. <br /> <br /> Ms. Dennis compliment staff and the appellant for a complete staff report package and <br />her questions were answered by the written material. <br /> <br /> Mayor Pico asked if the club facility would lend itself to an entrance near Chabot Drive <br />rather than the entrance in the Hopyard parking lot. Would there be negative impacts to <br />neighboring business on Chabot? <br /> <br /> Mr. Swift said the premises does have a corridor access to the Chabot side. That side <br />does not have any residences, hut there are two hotels across the street. There have been no <br />complaints from the hotels, primarily because hotels usually are designed with double-paned <br />windows and individual air conditioning units, so the rooms are insulated from activities in <br />commercial areas. The parking lot on the Chabot side of the Marque is much smaller than the <br />one adjacent to Hopyard. The question is whether enough patrons could park on that side or <br />would they spill over into the Hopyard and Inglewood Road sides. The number of allowed <br />occupants (350) would easily spill out of the Chabot side parking lot. <br /> <br /> Mayor Pico felt that could potentially split the crowd and reduce the noise at early hours <br />of the morning. <br /> <br /> Mr. Swirl said the key is the parking lot, but staff could not find a way to solve the <br />problem. Some ofthematerial submitted with the packet indicates the owner would potentially <br />modify the business plan so as to have a pizza parlor on the Hopyard side and the dance club on <br />the Chabot side. That goes a long way to address the key concern because it reduces the <br />occupant load of the dance club and moves the entrance to the other side. Staffrecommends that <br />that kind of change should come back as a separate use permit. <br /> <br /> Mr. Campbell asked how willing the owners of the Marque were to accept strategies to <br />alleviate the problems with the neighbors or did suggestions fall on deaf ears. <br /> <br /> Mr. Swift said it took the owner a long time to take the first steps to try to control the <br />patrons in the parking lot. Even then, the actions were not successful because of the large <br />number of patrons and the time they were leaving the club.
