Item 6b <br />PAP-34 (UP-94-20), Carlos Ratinho (The Marque) <br />Appeal of the Planning Commission's suspension of a conditional use permit to operate <br />The Marque dance club and bar at 4555 Hopyard Road~ Suite C-19. (SR 02:205) <br /> <br />Brian Swift presented the staff report. <br /> <br /> Mayor Pico asked if the Police Department could give a summary of the incidents and <br />their concerns.. <br /> <br /> Capt. Dave Radford agreed that this club has been a strain on police resources. Some <br />evenings, 75% of the patrol force was committed to the parking lot of the Marque and in <br />response to noise complaints fi.om residents. <br /> <br />Mr. Campbell asked what has happened recently? <br /> <br /> Mr. Radford said since the Planning Commission decision (July), police acfivites have <br />decreased. For the month of August about four hours of staff time was spent at that location and <br />half of that was for calls for service, including a couple of noise complaints, and the other half <br />was on officer initiated activity. <br /> <br /> Mr. Campbell noted that other establishments such as Masse's and Toby's have had noise <br />problems. At those businesses, some kind of program was implemented and the problems have <br />been reduced. <br /> <br /> Capt. Radford said it was not implementation of any programs, but rather of working <br />with the management. In the case of Masse's, its location is isolated with no residences nearby <br />and there were never any residential complaints of noise. <br /> <br /> Mr. Campbell asked how willing the owners of the Marque were to work with staff when <br />the noise complaints first started. <br /> <br /> Capt. Radford said that Sgts. Parker and Dunn met with the management of the Marque <br />at least five times and made suggestions for improvement, one of which was to play slow music <br />just before closing time. The management of the Marque said that would not work and did not <br />do it. There were other suggestions, such as increasing the number of security guards, and that <br />was not done until after the Planning Commission meeting. <br /> <br /> Ms. Michelotti asked for an explanation of the location of this business in relation to the <br />neighborhood as compared to Shaboom or other dance clubs. <br /> <br /> Mr. Swift said the key issue is the location of the parking lot. So long as the doors are <br />closed, noise fi.om inside the club has not been an issue. The parking lot abuts Hopyard Road <br />and the entrance to the club faces Hopyard. Shaboom is on the other side of the shopping center <br />and faces the non-residential street. The parking lot that serves Shaboom is on the opposite side <br />of the building, so patrons have a building to buffer the parking lot noise from the Val Vista <br /> <br />Pleasanton City Council 6 09/03/02 <br />Minutes <br /> <br /> <br />
