Ms. Michelotti indicated the City and School District had made an agreement which was
not easy to reach. The driving force was the proper location of the PG&E line. Timing is of the
essence. Money is on the line to build the road and even if the development agreements are not
signed, she was certain there is consensus among the property owners. She thanked Mr. Hahner
for his positive comments.

Item 6b
PUD-98-07-2M, Applied Biosystems
Application for a ma]or modification to an approved Planned Unit Development (PUD 98-
07) to modify the approved construction hours for the Applied Biosystems' pro. iect at 6001-
6085 Sunol Boulevard. (SR 02:187)

Brian Swirl presented the staff report.

Mr. Campbell wanted assurance there was a mechanism by which citizens could register
complaints about noise.

Mr. Swift said Applied Biosystems has instituted a hotline and given the telephone
number to all neighbors. There have not been any complaints received to date. The conditions
of this approval state that if the Planning Department receives any complaints, it has the
authority to take action to mitigate problems.

Mayor Pico asked why the applicant wanted to change the hours.

Mr. Swift said it was because it is trying to complete the first two buildings so the
employees currently residing in leased premises in Foster City can be moved to Pleasanton.
They are under a tight deadline because it took longer than expected to get through the permit
application procedures. The key issue now is the Sunol Boulevard widening improvements.
Those need to be completed before occupancy. If that construction is not done this summer and
fall, bad weather could affect the occupancy.

Ken Mantoani, Applied Biosystems, 34 Mapes Way, San Carlos, 94070, indicated the
company is under a very tight time frame to relocate from a Foster City building which is due to
become a water tank for the City of Foster City. He also wanted the opportunity to take
advantage of the dry weather for the street work. He indicated Applied Biosystems is very
concerned about the neighborhood and want to be good neighbors. The hotline was set up in
January for communication with the neighborhood. During that time, the existing 300,000 sq. fi.
building was demolished, 300,000 cubic yards of earth have been moved and foundations have
been dug and then poured for two buildings. The steel has been erected for one building and the
berm next to the road was built. During all that, no calls have been received. He acknowledged
the Planning Department can stop construction if there is a problem.

Ms. Ayala urged the company to make use of the pleasantonjobs.com website to match
local employees with local jobs.

Pleasanton City Council
Special Meeting Minutes

10 08/06/02
