Item 6b <br />West Las Positas Interchange Alternatives Study by the West Las Positas Interchange <br />Community Advisory Committee. <br />(SR 02:102) <br /> <br /> Ms. Michelotti indicated that she had been informed that the conflict of interest <br />regulations had changed and she no longer has a financial conflict of interest on this matter. <br /> <br /> Mr. Roush clarified that based on prior Fair Political Practices Commission regulations, if <br />a Councilmember owned property between 300 and 2,500 feet of a project, the member might <br />have to be disqualified depending on the financial impact of the project on the member's <br />property. Ms. Michelotti's residence is between 300 and 2,500 feet of the interchange and he <br />had recommended that she disqualify herselfi The regulation has changed to a flat 500 feet. She <br />can now participate in the matter. <br /> <br />Randall Lum presented the staff report. <br /> <br /> George Homolka gave a PowerPoint presentation of the report of the West Las Positas <br />Committee. He indicated this was a consensus report and the result of many compromises. He <br />believed some of the criticism of City staff is unfounded. This committee was run by the <br />members, not the city staff: <br /> <br />Ms. Dennis asked how long a NEPA study was good for? <br /> <br />Mr. Homolka said about 18 months. <br /> <br /> Ms. Michelotti asked what part of previous studies over the last five years could be used <br />in the new environmental document? <br /> <br /> Mr. Homolka said the issues to be found in NEPA that would be different than CEQA <br />would be the Endangered Species Act. There are two different statutes, California statutes and <br />the federal laws. Different matters would be looked at. The study would be expanded to include <br />the species listed in both the Acts. The construction will be in the creek area, so there will be <br />Corps of Engineers issues which are covered in the NEPA. Staff has been through these issues <br />with the golf course. He said any study done for the initial report will expire at some point. <br /> <br /> Mayor Pico asked if the process were split into two topics, one to eliminate the West Las <br />Positas interchange from the General Plan and the other to review improvements and other <br />mitigations items, such as Stoneridge and other areas in the City, would the General Plan <br />amendment require a NEPA study? <br /> <br /> Mr. Homolka said most likely it would not. He indicated there is a standing freeway <br />agreement with the State of California regarding the access at West Las Positas.
