The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Campbell, Dennis, Michelotti, and Mayor Pico <br />NIOEg: l~,/one <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Mayor Pico believed it could be appropriate to approve some mitigation for the Parkside <br />residents. Even though the issues are not identical, he indicated the City has shared the cost of <br />fencing with the Val Vista park expansion. In that case the fence was falling over, it was on <br />City-owned land, and there was some potential liability. The City agreed to share the cost of the <br />fence with the residents. He believed it would be appropriate for the City to consider some <br />sharing of the cost of replacing fences for the Parkside residents who want to change their <br />fences. He felt there were some who want to keep the chain link fence and some who will want <br />an eight foot fence, and some who want gates. He did not support the City paying the entire cost. <br />He suggested a mitigation program where the City would pay no more than $18 per foot for <br />those residents who want to modify their fences. He would also set a time limit of X number of <br />years from the date the trail is opened. <br /> <br /> Ms. Michelotti said that as the Parkside development was approved, the chain link fence <br />was installed to give the people the ability to look out over the arroyo as an extended open space. <br />She agreed people should have the choice, but there are also issues about public access points. <br />She felt there should be public access in appropriate places, and she would like to see the Zone 7 <br />policy regarding private access modified to allow that. She did not see a problem with allowing <br />eight foot fencing versus seven foot fencing, if people wanted to pay for that. <br /> <br /> Mr. Wolfe said staff's understanding is that the existing fence belongs to Zone 7. Any <br />fence that would be added would be on the property owner's side. Regarding the issue of the <br />gates, it would require an amendment of the City's existing agreement with Zone 7, which <br />prohibits additional private gates to the Zone 7 access roads. Zone 7 representatives have <br />indicated the Zone 7 Board would have to agree to modify the agreement. Discussions have <br />indicated that the property owners who wish to have those gates would have to indemnify Zone 7 <br />and the City for any access. There does seem to be some willingness on the part of Zone 7 staff <br />to look at this issue, but it is not a decision the City Council can make. <br /> <br /> Ms. Michelotti felt the Council could make a recommendation to move forward with that. <br />She felt that was a positive step. <br /> <br /> Mr. Campbell supported the comments of the Mayor and Ms. Michelotti and wanted to <br />move forward. <br /> <br /> Ms. Dennis referred to the list of mitigations. She believed the City was responsible for <br />miming a secure facility, so the City would see that the trails were operated in a safe manner. <br /> <br /> Mr. Wolfe said if Ms. Dennis was referred to item 3 on the list of mitigations, he could <br />not commit to that because he has not had discussions with the Police Chief.
