Police Department would treat the area as it does any other area. There is increased patrol ability <br />with the off-road bikes. However, he could not guarantee there would be increased surveillance <br />over a specific area. <br /> <br /> Ms. McKeehan said the City does not do that in any area of town for a particular issue. <br />When there are concerns, there is increased attention to an area for a while. <br /> <br /> Ms. Dennis asked if the City or East Bay Regional Park District had the volunteer bicycle <br />patrols on the trails on the Ridge? <br /> <br /> Mr. Wolfe said the City had a volunteer bike patrol group on the Ridge. That was to be <br />transitioned to the responsibility of the Police Department at the request of the Police Chief. The <br />volunteer group likes to ride up there. The Police Chief wanted more of an enforcement ability <br />in the event there are incidents. Staff wanted to have a more scheduled type of service and the <br />volunteers were not able to provide that. <br /> <br /> Ms. Dennis had no problem with the fence heights suggested, but wondered if the <br />homeowners could build any type of fence they wanted on their property. <br /> <br /> Mr. Wolfe said the existing Code allows people to request specific fence types. One <br />difficulty with this mitigation item was that it wanted a fence "without individual discretionary <br />review, public hearings or other burdensome planning process." Staff had difficulty giving <br />blanket approval for people to put in whatever height fence they wanted. There is an established <br />process and the Planning Director said it is unusual to deny this type of application, but if a <br />neighbor had an issue with a particular fence, there should be the ability to allow them to <br />comment. It is not the fence height, but the process to allow review. <br /> <br /> Ms. Dennis felt the one contentious issue was compensation for the property owners. <br />The actual impacts on these properties is speculative at this point. She was concerned about <br />committing to a specific financial compensation, until the trail is opened and people use it, and <br />the neighborhood and the City knows the actual impact. She felt the City would be giving public <br />funds to build fencing on private property and that was not a good precedent. If anything, she <br />felt a fence should be built on the Zone 7 property, from one public agency to another public <br />agency. <br /> <br /> Mr. Wolfe said on the City staff level, there has never been opposition to the gates. That <br />is an issue to be resolved with Zone 7. <br /> <br /> Ms. Ayala pointed out that half the cost of the fencing would be about $88,000 and there <br />is only $115,000 in the trails fund. She said the City has not built fences for other houses that <br />back up to the Arroyo.
