Bemal Property. The City has some experience with this because near the downtown <br />there is a stream with massive oak trees, redwood, basketball courts, tot lot and acres of <br />grass. This has co-existed with Kottinger Place Senior Housing for the last 30 years. <br />There are also OrloffPark and Creekside Park set among other houses. The two concepts <br />can go together. As earlier pointed out, not all acreage is acreage that can be developed <br />and build things on. We are guaranteed to have some open spaces. He felt this could be <br />done and urged Councilmembers to give it some serious consideration. <br /> <br /> Jeff Renholtz, 7489 Aster Court, discussed the steps the City is taking with this <br />process. There will be an election in November and on the ballot will be an initiative <br />called the "Citizen's Initiative." The staff process includes ratification, which is to ratify <br />what the Task Fome has done. This might or might not be on the November ballot, and if <br />not on this upcoming election, it must be on a general election ballot. If this is not on the <br />2002 ballot, what are implications from the Citizen's Initiative and how does this impact <br />what can and cannot be done. Secondly, is there was a specific timeline? Thirdly, is the <br />Citizen's Initiative a Specific Plan? Fourth, after the approval of the Specific Plan, what <br />kind of changes are permitted and would those then have to be voted on? <br /> <br /> Mr. Swift responded by talking about the possibility of Phase Two land uses <br />getting on a future ballot. Until that happens, the only things that could be developed or <br />built on the Bernal Property would be those land uses that were incorporated into the <br />Phase One plan, e.g., the community park, the fire station and the neighborhood park <br />component of the oak knoll area. Those could move forward as Council wishes, however <br />no other land uses could be established until there is a vote. The Citizen's Initiative is <br />structured as a specific plan amendment to the Phase One Specific Plan and it is, in fact, a <br />specific plan. It adopts new policies that are added to the Specific Plan. There would be <br />no modification of those policies without another vote of the people, if it were to pass. It <br />has a number of policies that would take effect, assuming it was adopted in November, <br />upon its adoption. The one that prohibits residential development would not really come <br />to pass because you couldn't put any residential development until you do the next phase, <br />The Phase Two Plan. The policies with respect to leasing or selling City property would <br />take effect immediately and would then govern and could be changed by the electorate. <br />He didn't feel this would cause any problems for the City to establish any of the parks or <br />the fire station. <br /> <br /> Ms. Micbelotti asked Mr. Swift to repeat the specific plan portion of his <br />explanation, and asked if it was a specific plan amendment to Phase One, and only Phase <br />One. Phase One included just the community park and the private development. <br /> <br /> Mr. Swift said the Phase One Specific Plan includes policies that apply over all <br />the Bernal Property.
