Mr. Swirl said those are the key issues.

Mr. Renholtz asked if the Citizen's Initiative passes in November, precluding the
use of any of the property for any kind of additional housing, then the City comes before
the voters with a specific plan that allows housing, would that supercede the prohibition.

Mayor Pico said he understood that if both items are on the November ballot and
a City Council sponsored measure passes by more votes, it would supercede the Citizen's
Initiative. Thank you, Mr. Renholtz, for the good questions.

Mr. Campbell asked if the Citizen's Initiative gets 75% and a year later the
Council sponsored initiative gets 51%, does the later initiative supercede the prior one?

Ms. McKeehan said yes.

Ms. Michelotti said if there are to two initiatives, one citizen sponsored and one
Council sponsored, in November and the Citizen's Initiative gets more votes, then it
would take a future vote to override it.

Mayor Pico said if the Citizen's Initiative passes, and if the people wanted to add
housing to the property or they want to sell part of it or they want to make it not
accessible by the public, an item could be on the ballot, either the Council could or the
citizen's could and if it passed, it would supercede the Citizen's Initiative.

Ms. Michelotti asked about the scenario where the Task Force recommendations
get deferred, but later they are adopted by the voters. Any housing that might come
forward would still have to go through a PUD process that is referendable.

Jack Dove, 5250 Case Avenue, Suite 110, spoke on behalf of the Tri-Valley
Interfaith Poverty Forum and was asked by Pat Belding to read her comments. It reads,
"I am the spokesperson tonight for those of us from the Tri-Valley Interfaith Poverty
Forum, which has been working for more affordable housing in Pleasanton and
specifically on the Bernal Property and the report of the Task Force, which is being
considered tonight. First, I want to compliment the Task Force for the great job they did
over the period of many months listening to the needs and desires of the community.
From January 2001 on, at it's regular meeting and its town meetings, its members have
given patient consideration to the points that were brought forth and tried to do their best
that they could in an orderly way to make good recommendations to the City Council for
the long term use of this property in the City of Pleasanton. My view is that this due
process has been inappropriately interrupted by the actions of some members of the Task
Force and others in the community, which has resulted in an initiative on the November
ballot prohibiting one of the uses that the Task Force recommended, that of Affordable
Housing. Since it has been done, my suggestion is that the City Council delays the
consideration of the Bemal Task Force Report and the public vote on its
recommendations until after the November election. We need to be careful that the
voters are not confused and I think that one measure on the ballot will make the issues

Pleasanton City Council 14 06/04/02
Minutes
