Mr. Roush said if the intent was to require the fees at the building permit stage, but to <br /> allow a payment schedule, staff could work with Mr. Mendez to devise a realistic plan. <br /> <br />Ms. Michelotti asked if this would be done for everyone? <br /> <br /> Mr. Roush felt if it is allowed for Mr. Mendez, it is likely the next applicant will ask for <br />the same thing. <br /> <br /> Ms. McKeehan indicated in the Winter case, there was no discussion about when the fees <br />would be paid. Staff was beginning to advise applicants that in-lieu fees would be payable upon <br />taking out building permits. The argument in this case could be made that because the Mendez <br />application has taken so long, that it would be acceptable for Council to make one last deferral of <br />fees. If Council should decide to allow a payment schedule, it is not the staff recommendation to <br />allow them in the future. <br /> <br />Ms. Michelotti did not remember the Spring Street situation as being the same as this. <br /> <br /> Mr. Swift said there was never a discussion with the Winters about the timing of the fees. <br />The only issue was how many spaces. <br /> <br />Ms. Michelotti remembered the Winters had gotten some kind of relief from the fees. <br /> <br /> Mr. Roush said the City had agreed to reimburse them if they were able to get a <br />reciprocal parking agreement with the neighbors for some of the required spaces. <br /> <br /> Mr. Swif~ said that project was completely different from the Mendez application. It <br />started with a small addition to a residence, which would not have required a single parking <br />space, then changed into an expansion of a commercial building, then changed to a complete tear <br />down and rebuild of an all new commercial building. There were many different ways to <br />characterize it. <br /> <br /> Ms. Michelotti indicated her opinion that from this time forward, any applicant will know <br />what the rules are. The Specific Plan has been adopted and will govern in the future. <br /> <br /> It was moved by Ms. Ayala, seconded by Ms. Dennis, to require the in-lieu parking <br />fee when building permits are taken out. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Campbell, and Vice Mayor Deamis <br />NOES: Councilmember Michelotti <br />ABSENT: None <br />ABSTAIN: Mayor Pico <br /> <br />Pleasanton City Council 26 <br />Minutes <br /> <br />03/05/02 <br /> <br /> <br />
