Ms. Dennis asked if the ow~aer of the Spring Street propea'ty was required to pay the in- <br />lieu parking fees when he took out his building permit? <br /> <br />Mr. Swirl said yes. <br /> <br /> Ms. Ayala felt Council gets itself into trouble when it starts making exceptions. The City <br />must deal with its parking problems downtown and she preferred to have the funding in advance. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Campbell and Michelotti <br />NOES: Councilmember Ayala and Vice Mayor Dennis <br />ABSENT: None <br />ABSTAIN: Mayor Pico <br /> <br /> It was moved by Ms. Ayala, seconded by Ms. Dennis, to require the in-lieu parking <br />fee when building permits are taken out. <br /> <br /> Ms. Dennis supported the motion because another property owner has been required to <br />pay the fees in advance and in fairness, no exception should be made now. <br /> <br />Mr. Campbell asked if that means parking fees will never be deferred? <br /> <br />Ms. Dennis said deferral has been stopped under the Specific Plan. <br /> <br /> Ms. Ayala felt that was because the City is getting very close to doing something about <br />the parking problems and will need funding. She was concerned that some properties have <br />changed hands since deferred parking fee agreements were signed and the new owners will be <br />surprised when the City makes demand for the fees. <br /> <br /> Ms. Dennis felt the reason the Specific Plan has been changed to require payment of the <br />fees when building permits are issued is because of the demand from the community. She <br />acknowledged that it is difficult to be the first ones to whom a new rule is applied. If another <br />owner had not already been required to abide by the new rule, she might have a different <br />opinion, but she did not think it fair to treat one owner differently than another. She would <br />support staff working with Mr. Mendez for some kind of payment schedule, but the obligation <br />should apply at the time of the building permit. <br /> <br /> Ms. Michelotti indicated she would like to further review the circumstances surrounding <br />the Winter family issues surrounding the 216 Spring case before deciding on the Mendez case. <br /> <br /> A substitute motion was made by Ms. Michelotti to allow a payment schedule for <br />Mr. Mendez. <br /> <br />The motion died for lack of a second. <br /> <br />Pleasanton City Council 25 03/05/02 <br />Minutes <br /> <br /> <br />
