Item 6e
Potential Ballot Measure for Land Uses on Bernal Avenue Property.

(SR02:056)

Ms. Michelotti asked if Item 6c had to be discussed at this meeting?

Ms. McKeehan indicated staff brought this forward. The Task Force is making decisions
and will bring back a plan for a park. This report was for Council's benefit, because if Council
wants this on the ballot there are certain things that need to be done. If the language is general, it
can make the November 2002 ballot. However, if Council wants the language to be specific, it
would not be possible to get it on the November ballot because of the timing of the
environmental work.

Ms. Michelotti felt it was too late in the evening to discuss this and make a good
decision.

Mr. Campbell asked why it had to be voted on?

Ms. McKeehan said Council has not made a decision to put the plan to a vote.

Mayor Pico requested that this item be continued to the next Council meeting on
March 19, 2002.

Item 6d (4j)
Approve Language for Argument in Favor of Happy Valley Annexation.

Mr. Roush presented a brief staff report and indicated that Mr. Howell would like to
change a word in the final paragraph from "requires" to "allows".

Ms. Michelotti suggested using the word "encourages" because it more accurately
reflects a state mandate.

Mayor Pico did not think the Council as a whole was writing the argument. The only
issue was who was going to sign it. The content of the argument is the responsibility of those
signing it and he did not think Council should draft the argument, especially since none of the
Councilmembers will be signing it. He felt that if there were five residents who are directly
affected by this annexation who what to sign it and also to write the rebuttal argument, then that
is the most appropriate action.

After Council discussion, it was determined that the best course of action, if possible, was
to have the residents draft and sign the argument and rebuttal.

Mayor Pico invited public comment.

Pleasanton City Council
Minutes

27

03/05/02
