and reminded people in the community that the District and developers have already signed the <br />agreement and have moved forward with significant progress. Although timing and the economy <br />have made it more difficult to get the infrastructure necessary to complete Neal Elementary, she <br />said the District has done everything it can and has given hours and hours of work to provide <br />information to answer outstanding questions. She urged Council to approve the agreement so <br />they can move forward. <br /> <br />Ms. Ayala did not understand how this could stop construction at the school site. <br /> <br /> Ms. Lemmons said the Cooperative Fee Agreement takes care of the elementary school. <br />The cash flows are based on the Gift Fee Agreement to provide the funds necessary to finish <br />other projects. At present there are classroom buildings under construction at Foothill and <br />Amador High Schools. Those cash flows will be affected if the Gift Fee Agreements cannot be <br />approved. <br /> <br />Ms. Ayala pointed out that the Girl Fee Agreements are not under consideration. <br /> <br /> Ms. Lemmons stated the District wanted to get the Cooperative Fee Agreement resolved <br />so it could put all its energies into the Gift Fee Agreements. Staff and its attorneys are close to <br />formulating language that will satisfy all the local developers. <br /> <br />Ms. Ayala asked how many of the Points of Agreement had been accomplished to date? <br /> <br />Ms. Lemmons said several had been accomplished. <br /> <br /> Ms. Michelotti indicated she had worked on this for two years and she appreciated all the <br />efforts made by the School District staff. She hoped that in two weeks Council could act on this <br />and finalize the agreement. <br /> <br /> Sonya Howes, 4890 Seaview, Castro Valley, President of the Teachers Association in <br />Pleasanton, indicated she was extremely upset that after two years' work and all the lawyers <br />involved, that this agreement is derailed at this time. On behalf of her colleagues, she is <br />concerned that as a result of this continuance the construction will stop at the schools. <br /> <br /> Gloria Fredette, 3731 Oakbrook Court, asked Council to put this item back on the <br />agenda. She asked if Council wanted to be remembered as having stopped construction at the <br />high schools and jeopardizing 13,400 students in this District. <br /> <br />Ms. Ayala asked staff if this would stop construction at the high schools. <br /> <br /> Mr. Roush did not see how this action could directly effect construction. He did not <br />know what the School Board has discussed and how it reached the conclusion that construction <br />must stop. This action would simply amend an agreement that has been in place since 1993 <br />concerning the payment of school impact fees by two developers. Without knowing the thought <br />process of the School Board, it is difficult for him to speculate on the relationship between <br />Council's action to continue this and stopping construction at the high schools. <br /> <br />Pleasanton City Council 6 09/18/01 <br />Minutes <br /> <br /> <br />
