She hoped the City of Dublin will also participate in finding solutions. She hoped to <br />have state recognition of regional solutions for local housing goals. <br /> <br /> Jennifer Hosterman, 2922 Chardonnay Drive, indicated that as a candidate she <br />had been looking forward to the portion of the agenda for Matters Initiated by Council. <br />She will now make use of the Meeting Open to the Public portion. She thanked Ms. <br />Dennis for offering her the opportunity to address the California Regional Water Quality <br />Control Board regarding the Happy Valley golf course. She was willing to do that again. <br />She then indicated that when issues arise in the community there is usually a venue to <br />address them, whether a committee, commission or task force. The one thing missing is a <br />committee or commission to review environmental issues. Some issues to be dealt with <br />are transmission of electricity locally, pesticide uses, water availability, conservation <br />issues, composting, etc. The City could then be proactive on environmental issues. She <br />asked Council to consider this. <br /> <br /> Eileen Fenell, 3231 Vineyard Avenue #70, restated the concerns of the residents <br />of the Hacienda Mobilehome Park. She believed the rent increases were unfair and not in <br />accordance with the City Agreement. She quoted from the Rent Stabilization Agreement <br />and stated that Formula B should be used for calculation of rent increases. The new <br />owners are using Formula A and that is unacceptable to the residents. She also indicated <br />the park owners have reduced service levels which are not reflected in the accounting for <br />operating expenses. She felt the Agreement has no teeth to force compliance. She asked <br />the City to file an injunction to enjoin the Park Owners from billing any rent increases on <br />January 1, 2001 until the correct mount has been determined through the Pleasanton <br />Mobilehome Committee. She also indicated refunds had not been paid to certain <br />homeowners who had overpaid space rents from July through December. <br /> <br /> Mr. Roush indicated the Mobilehome Committee will be meeting on <br />December 15, 2000 to select the neutral member and will set dates in January and <br />February for further meetings. He has had discussions with the park owners and they <br />agreed to use Formula B, but that may increase rents. <br /> <br />Ms. Ayala asked if the rents could remain the same until the issues are resolved. <br /> <br /> Mr. Roush indicated he had discussed this matter with the park owners, but they <br />did not agree. If it is ultimately decided the rents have not been calculated correctly, the <br />City can go to court and require restitution to the tenants that have overpaid. <br /> <br />Mr. Campbell asked who ultimately decides which formula to use? <br /> <br /> Mr. Roush indicated the Mobilehome Committee will review that, the decision <br />can be appealed to the City Manager, who would appoint an impartial arbitrator. There is <br />still another remedy if the Council feels there has been a breach of the Agreement, and <br />that is to file a lawsuit. There are two avenues available. He hoped the Committee will <br />be able to resolve this issue in the near future.
