Item 6b <br />PUD-97-01, Currin Construction <br />Application for certification of the f'mal Supplemental Environmental Impact <br />Report (SEIR) for Oak Tree Farm - Phase 3 project and removal of the <br />geotechnical setback line, commonly referred to as the "Berlogar Line" from the <br />existing Oak Tree Farm subdivision located on the west side of Foothill Road, south <br />of the Castlewood country Club and across from the Verona Bridge. Zoning for the <br />property is PUD - RDR / LDR (Planned Unit Development - Low Density <br />Residential / Rural Density Residential) District. (SR 01:186) <br /> <br />Brian Swirl presented the staff report. <br /> <br /> Ms. Dennis asked Mr. Swirl to briefly discuss for the audience the <br />recommendations for further mitigation made by the Planning Commission. <br /> <br /> Mr. Swirl responded by saying when the Planning Commission reviewed the <br />Supplemental Environmental Impact Report they raised three issues. The first had to do <br />with the biological analysis that was in the original Supplemental Environmental Impact <br />Report, which is now two years old. Since that time the Fish and Wildlife Service has <br />designated much of Pleasanton Ridge as Critical Habitat Area for the Alameda Whip <br />Snake, and the California Red-legged Frog. The Planning Commission felt that before <br />any further subdivision occurred, which does not effect the geotechnical line issue which <br />is before Council tonight, that a subsequent biological assessment of the site be <br />undertaken and the results forwarded to the various State and Federal agencies. That <br />mitigation measure has been incorporated as part of the recommendations of the final <br />Supplemental Environmental Impact Report. The second issue had to do with the <br />monitoring of groundwater and technical issues of what parameters go into the formula to <br />determine the stability of a hillside. The Planning Commission was concerned that not <br />enough evidence of groundwater levels was in place at the time the geotechnical studies <br />were done. Staff is comfortable that in the "worse case" analysis that was prepared <br />included an assumption of groundwater levels that are far higher than is likely to be <br />found. The last modification had to do with the information that would be provided at <br />the time the subsequent application for new subdivision comes back before the City. The <br />Planning Commission asked for analysis of hillside movement and the subsequent impact <br />to a critical strncmres, such as a hospital or police station, and required that any structures <br />be built to withstand a high magnitude seismic event. They wanted this information in <br />order to put the corresponding information for residential units in context of a safer <br />structure. <br /> <br /> Rita Martin, 2860 Sanderling Drive, Fremont, is the owner of 8187 War Glory <br />Place in Pleasanton. Her property is Lot Seven in Phase Two. The geotechnical setback <br />line runs through her property and said she is in favor of having the line eliminated. <br /> <br /> David Glenn, 10 Tehan Canyon Road, Pleasanton, had concerns regarding the <br />removal of the setback line. He discussed the difference in the amount of rainfall that <br />occurs at his residence versus the amount in Pleasanton.
