Pleasanton would manage the trail if it was decided to open it to the public. <br />What is the difference between how the City manages the sections of the trail that are <br />open to the public versus those not open? <br /> <br /> Mr. Roush said there is an agreement with Zone 7 concerning the public's use of <br />those access roads. Essentially, in exchange for letting the public use the roads, Zone 7 <br />has asked the City, and we have agreed, to provide a level of maintenance of those roads, <br />including accepting liability if someone is injured there. This is the trade-offthat the City <br />has been willing to undertake to allow the public to use the access road. Otherwise Zone <br />7 would just say no one could use these because they would not want to assume the <br />maintenance and/or the liability. <br /> <br /> Ms. Dennis said the City would be responsible for things like weed abatement, <br />noticing people if they could not use the trail, if there were an instance of high water, or if <br />there was a problem. She understood there would be some additional expense to the City <br />if the trails were open. She is assuming that some of it has to do with the City's <br />management of public access to this area. <br /> <br /> Mr. Ronsh said there is an additional cost to this. As Mr. Lure mentioned, if there <br />were flooding issues, the City would barricade it to make it obvious people should not <br />use it until further notice. There are some other incidental costs that the City would have <br />as part of the maintenance program. Zone 7 currently does the weed abatement and they <br />would continue to do it; although the City would require other kinds of maintenance <br />issue~. <br /> <br />Mr. Pico asked if there were any additional questions. <br /> <br /> Ms. McKeehan said that the noticing issue is a constant battle and staff tries to do <br />the best job it possibly can. For this meeting alone over 11,000 notices were sent. This <br />does not count the City wide notice that was done for the water and sewer item on the <br />agenda. The City does its best, but being postcards, the notices might get stuck inside of <br />"junk" mail or people ignore them. There were a significant number of notices sent for <br />this meeting. <br /> <br /> Mr. Pico asked if there were any desire of any Councilmember to wait and <br />continue this item until the next meeting. <br /> <br /> Ms. Ayala said she would have liked for Councilmember Campbell to be present <br />this evening because he is a huge trail supporter. She told the audience that she is also a <br />huge trail supporter.
