L.P. and Habitat Issues <br />(SR 00:104) <br /> <br />Randall Lum presented the staff report. <br /> <br /> Ms. Dennis indicated she had discussed with staff how the transfer of property to <br />the homeowners association and implementation of the environmental mitigations would <br />occur. She had wanted assurances the mitigations would be completed and suggested <br />bonding for the cost of these improvements. A lcacr was provided to her by Signature <br />Properties setting forth the timeline for completion of the mitigation measures. She also <br />had questions regarding the jurisdictions of the various cnviroranental agencies. She <br />indicated she had spoken to Molly Martindale of the Army Corps of Engineers, who had <br />visited the site and was satisfied with the schedule provided by Signature Properties. <br />After that discussion, she was satisfied with the recommendations in the staff report. <br /> <br /> Ms. Ayala indicated she also had concerns about the environmental work and <br />asked staff to review these issues. She wanted a copy of the tlmeline and questioned why <br />this final map should be approvcd when some of the work is still not completed. She <br />indicated she had spoken to Ken Sanchez of the United States Fish and Wildlife Service. <br /> <br /> Ms. Seto reviewed the supplemental staff report regarding the habitat issues and <br />indicated more information will be provided to Council when it reviews the last of the <br />fma[ maps for Ruby Hill. <br /> <br /> Mayor Tarver poimed out that Signature Property has been working on the Ruby <br />Hill development since 1993 and he believed all the mitigation measures could have been <br />completed by now. <br /> <br /> Mr. Swift explained that these mitigations could not be constructed until this point <br />in time. For instance, the habitat pond was being used as a detention basin during <br />construction and could not have been converted to weftands habitat until that construction <br />was completed. The County approvals did not have timing requirements and now is the <br />time when the final mitigations will be installed. <br /> <br /> Mayor Tarver was not prepared to vote on this item at this time. He wanted a <br />comprehensive evaluation of all the conditions of approval and conditions set forth in <br />agreements with Signature to ensure that all have been accomplished as required.
