not believe a bond was sufficient to insure the completion of the mitigations, referring to <br />a difi~rent development. <br /> <br /> Mr. Roush stated that in this case Signature Properties is providing cash. which <br />the City will hold until the work is completed. <br /> <br /> Mayor Tarver asked how long it would take to do the work as well as provide an <br />independent analysis. <br /> <br /> Ms. Seto said an analysis is currently underway and Signature has already <br />deposited one-half the required funds. <br /> <br /> Ms. Dennis 'added that staff is going through an audit of all outstanding issues. <br />She realized them are issues besides the habitat and the road and asked what conditions <br />are linked m the tentative map. She thought the tentative map only required a monitoring <br />program. <br /> <br /> Ms. Seto explained that there are no specific timelines in the various conditional <br />approvals so long as the developer is in compliance with the plan. <br /> <br /> Ms. Ayala indicated Mr. Sanchez had stated he did not know of any homeowners <br />association that had taken over a habitat area for maintenance. She asked if the property <br />owners would be advised of this. <br /> <br /> Ms. Seto explained the City of Pleasanton has a conservation easemere and will <br />inspect the area to make sure the open space is maintained. The homeowners association <br />is only the property owner. She indicated every property owner is provided with this <br />information and full disclosures have been made. <br /> <br /> Ms. Ayala indicated Mr. Sanchez had made a presentation to the Livermore City <br />Council and felt it would be worthwhile for him to do the same for Pleasanton. She <br />rel~rred to new legislation regarding endangered species and asked if that applied to this <br />project. <br /> <br /> Ms. Seto stated that m~der the current plan, Signature Properties repor's to the <br />state Fish and Game Depamnent; the Fish and Wildlife Service is a federal agency. The <br />tiger salamander habitat was mquimd by the state and there was no mention of rod legged <br />frogs when the project was approved. <br /> <br /> Ms. Michelotti referred to Ms. Ayala's comment about a presentation by Mr. <br />Sanchcz and asked what would be discussed. <br /> <br /> Ms. Ayala said she had questions on this particular habitat. She also referred to <br />lhe letter sent by the Mayor supporting a regional habitat program. She would appreciate <br />any information to help the Council understand this and deal with problems.
