The roll call vote was as follows: <br />AYES: Councilmembers Ayaia, Dennis and Michelotti <br />NOES: Mayor Tarver <br />ABSENT: Councilmember Pico <br />ABSTAIN: None <br /> <br />There was a break at 9:50 p.m. <br /> <br />The meeting reconvcned at 9:55 p.m. <br /> <br />Item 6c <br />PUD-99-03, William Kolb, Donna Miller, and Gene and Carol Strom <br />Aeplication for PUD pre-zoninff and PUD development plan approval for a <br />residential subdivision consistin:, of 12 new sinlie-family lots and two exislinE <br />sinlie-family homes, open seace, and Oublic park uses, and :~ublic street and <br />infrastructure improvements located on approximately 55.4 acrest and desilmatinl <br />an approximately 5.22-acre area for a future senior care facility. The overall <br />nroiect site is unincorporated and is located at 11393 Dublin Canyon Road. <br /> <br />Also consider adoption of a Neizntive Declaration orepared for the proiect. <br />(SR 00:122) <br /> <br />Brian Swirl presented the stuff report. <br /> <br />Ms. Miehelotti asked if the City would maintuin the park area. <br /> <br /> Mr. Swift said yes. The owner of Lot 12 will maintain a lire line between the <br />property and the park. The park property is natural open space with very little <br />maintenance required and will allow the creek area to be available for outdoor classes in <br />nature studies. There is also a rock outcropping with amheological value. <br /> <br /> Ms. Ayala asked if the commercial property owner would be requined to maintuin <br />the open space areas if the Preserve homeowners associalion did not assume that <br />responsibility. <br /> <br /> Mr. Swift said that was the original request by the applicant. The staff <br />recommendation is for a homeowners association to be created for that purpose. He <br />believed the applicant has agreed with that. <br /> <br /> Mayor Tarver ret~rred to the five acres being reserved for a future senior care <br />lhcility and asked if that were part of the twelve acres to be developed. <br /> <br /> Mr. Swift said no and further described its location.
