Ms. Acosta also indicated the last Pmal map would include an audit of all the
conditions and include a schedule for completion for those item to be done late.

Mayor Tarver did not support the motion and had the same questions Ms. Ayala
did, so he would be talking to staff.

Ms. Ayala wanted to make certain Mr. Sprout met with the Land Trust and asked
why this final map and the one for the last tract could not be appreved at the same time.

Mr. Roush explained the goal is to have the last ~tml map on the Council agenda
for May 16. In order to get the comprehensive audit the Mayor has requested. that may
not be possible. The developer has work that it would like to start and does not want to
wait until early June to do that.

Mayor Tarver was willing to make the developer walt so staff has a chance to do
it right. He was comfortable waiting until the first meeting in June.

Ms. Michelotti believed Ms. Dennis had done a considerable amount of research
on this matter and was comfortable that what should have been done to this point has
been done and the cash security has been posted. There is still one last final map to come
for review at which time every condition will be reviewed. She was comfortable that
cvcryttfi. ng that should have been done for Tract 7156 has been completed.

Ms. Ayala indicated she would be more comfortable if staff could assure her that
the audit and the last final map was not being rushed through and that the Land Trust has
had time to meet with Malcolm Spinal. She also wanted to meet with Ms. Lutz and Mr.
McKeehan to answer questions.

To Ms. Ayala's question, Ms. Michelotti responded that she is relying on the
answers of the experts and she trusted that information because they have been on the
property frequently. Ms. Lutz has not been on the property for two years.

Ms. Acosta indicated staff was aware there are a lot of questions and that is why
this item has not been bctbrc Council sooner. There should be time to meet with the
Land Trust while staff is completing its audit and the final report will include answers to
all questions. She encouraged Councilmembers to submit any questions they may still
have.

Mr. Roush indicated the report would not be rushed to be on the May 16 agenda.
Mr. McKeehan has indicated he is willing to walt until June.

Mayor Tarver said ifCoancil takes action on the final map before it, there are
only 26 lots left to control from all of the Ruby Hill project if there are any problems
found in the audit.

Pleasanton City Council 12 05/02/00
Minutes
