Ms. Ayala asked for clarification of the lapsing provision. <br /> <br /> Mr. Swift responded that the standard has been two years, but the Planning <br />Commission recommended three years, and staff concurs that is acceptable in this <br />instance. <br /> <br /> Mayor Tarvet indicated Golden Eagle Farms has been in existence since I986 and <br />the mqdired tree screening plan still does not hide the houses. <br /> <br /> Mr. Swift said the trees were not planted for a number of years and when they <br />were planted, some of the trees failed because there was no irrigation system. Staff <br />learned many lessons on that project. Ihe plan before Council now requires the trees to <br />be instailed with the initial fmal map and include an irrigation system. <br /> <br />Mayor Tarver declared the public hearing open. <br /> <br /> Peter MacDonald, 400 Main Street, Suite 210, representing the Kolb family, <br />indicated they had worked with a large team of experts on this project and they are all <br />proud of it. It is a trcc-t~icndiy project with every substantial and healthy tree being <br />preserved on the site. The concerns of the neighbors have been addressed and the project <br />is compatible with The Preserve development in style and value. It is a view-sensitive <br />design and will not be visible from 1-580. The design is consistent with the General Plan <br />and is well below the midpoint for density. He agreed with staff regarding the open <br />space maintenance as well as the other provisions of the staff recommendations. <br /> <br /> William Kolb, 11393 Dublin Canyon Road, indicated he lives in the house built <br />by his grandparents in 1912. It is still in good condition and he hopes to incorporate it <br />into an assisted living project in the future. He hopes to build a new home on top of the <br />hill near his sisters to create a family compound. <br /> <br /> Donna Kolb Miller, 11933 Dublin Canyon Roa& asked for Council approval for <br />this project. They have tried hard to meet the City requirements and have worked with <br />the neighbors. The property means a lot m them and their family has been there for <br />generations. They want a project they can be proud of and believe this is it. Thcrc is <br />development all sound them and she felt it was their tum now for this little fill-in <br />project. <br /> <br /> lames Fong, 9205 Klemetson Drive, lives adjacent to the subject development. <br />He was dismayed about the results of the Moller Ranch development and the lack of trees <br />among the houses. He wanted to be sure that kind of development is not repeated. The <br />Kolb project appears m be more environmentally sensitive. He asked about access to the <br />future senior facility and whether it would affect the park. He also inquired if the public <br />park would be locked at night.
