It was moved by Ms. Dennis, seconded by Ms. Michelotti, to adopt
Resolution No. 00-039, approving the 2000 Weed Abatement Program and
authorizing staff to proceed with abatement of weeds, rubbish or refuse upon or in
front of certain described properties within the City of Pleasanton which constitute
public nuisances.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Item 6d
Request by Passport Homes for reconsideration of its PUD condition that no lots be
sold nor building permits issued until the new Case Avenue elementary school is
onerational.. (SR00:107)

Brian Swift presented the staff report.

Mayor Tarver invited public testimony on this application.

John Ford, representing Passport Homes, agreed with the staff report and
explained that the intent of Condition 6 was that no home be occupied until the new
elementary school was opened. It is clear that the new elementary school will open this
fall. He presented a timeline for his project. The final map will be before Council in
June; it will take about three months to make site improvements and to have finished lots.
Assuming the lots are sold immediately it would take nine to twelve months to build a
custom home and the first house will not be occupied until May or June 2001. He urged
Council to consider his request for removal of the condition.

Hoss Bozorgzad, 6546 Arlington Drive, supported the request. He believed Mr.
Ford was optimistic in his timeline for home occupancy. Removing the condition will
allow potential buyers to begin looking at the parcels sooner. He urged Council to
approve the request.

There were no further speakers.

Pleasanton City Council 8 04/18/00
Minutes
