Kulhany had recently passed away and related the many helpful things he did downtown.
He then referred to limited public access on the street at the new bank building and asked
staff to review that comer. He stated he had heard that someone wants to remove the
train cars. He realizes they don't look good, but the Pleasanton Locomotive Association
will be working on them this summer. He said he had spoken to Scott Haggerty, who
was unaware of any formal request.

Ms. Michelotti said there was a formal written request to Supervisor Haggerty
from the current property owner a year ago.

Ms. Ayala asked how the cars got there in the first place.

Mr. Churka said he had put them there and they were delivered by crane. That is
Alameda County Transportation Corridor property and he had permission of the City
indirectly. They were on the plans when the parking lot was being reconstructed at the
train station and no one said anything, so he just brought them in.

Ms. Michelotti said the current property owner complained the cars are being
used as a storage area and they are unsightly.

Mayor Tarver said the City of Pleasanton has not taken any position to ask that
the cars be removed. The decision is under the jurisdiction of Alameda County for a
permit to stay or to have them removed.

Mr. Churka said it is not an issue to him, if the County wants them moved, he
would move them.

Ms. Michelotti asked about construction at the comer of Bemal and Sunol
Boulevard to create a spot to which the train cars would be relocated.

Mr. Churka said he did not know of any. There were tracks put in to emphasize
the Niles Canyon Railway extension.

Ms. Acosta said staff had received a number of complaints from people other than
the property owner because the area was becoming junky as long as two years ago. Staff
started working with various parties including Mr. Churka and the County Supervisor's
office. Some things were begun, but not completed, in terms of moving the cars or
cleaning up the area. There were some liability concems as well. She said the City had
been notified that the construction at Bernal and First was to relocate the cars, but that
has not happened. Supervisor Haggerty's office was well aware of the issue.

Ms. Ayala asked who owns the cars.

Mr. Churka said they are leased to the Pacific Locomotive Association.

Pleasanton City Council 6 04/04/00
Minutes
