Ms. Michelotti reiterated the plans as submitted turned out to be completely <br />different once constructed and Mr. Churka was responsible for those plans. <br /> <br /> Mr. Churka said he submitted 2200 square feet ofuseable space. It was always <br />3700 square feet, but he deducted the elevator pit, the elevator room, the stairwell, the <br />area underneath the porch, etc. <br /> <br /> Don Mendez, 4479 Mirador Drive, objected to the hearing because he did not <br />receive notice of the continued meeting. He wanted the meeting postponed. He believed <br />Mr. Churka had been given morn latitude than anyone else in the City. He objected to a <br />Councilmember asking for ways to make exemptions for him. He also objected to <br />exemptions for parking. Using a beauty salon as a use on the second story, he calculated <br />the need for an additional six spaces. <br /> <br />There being no further speakers, the public hearing was closed. <br /> <br /> Ms. Michelotti believed the Building Department has gone to great lengths for <br />many years to make allowances and work with people to help them accomplish their <br />goals. This is not a special case. She cited the extra efforts made to work with people <br />regarding the unreinforced masonry retrofit requirements for the downtown area. If there <br />is anything at fault, the Building Department has been too accommodating in this <br />instance. <br /> <br /> Ms. Ayala felt the first concern should be safety issues. She also believed there <br />was a pattern of disregard for the rules and it had been going on for a long time. In <br />fairness to everyone, she supported denial of the appeal. <br /> <br /> Ms. Dennis also had concerns about fire safety issues. She referred to the <br />question regarding steel frame and said a fire in Chicago involving a new all metal <br />building basically melted the building. She could find no merit in the issues under <br />appeal. <br /> <br /> It was moved by Ms. Michelotti, seconded by Ms. Ayala, to adopt Resolution <br />No. 00-034, denying the appeal. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Pleasanton City Council 16 <br />Minutes <br /> <br />04/04/00 <br /> <br /> <br />
