6. PUBLIC HEARINGS AND OTHER MATTERS <br /> <br />Item 6a <br />PAP-Is Aol}eal of the Plannin~ Commission's denial of the a0Oeal of the annroved <br />iandscaoin~ nlan for the residence located at 4i7 Sycamore Road. (SR 99:004) <br /> <br />Brian Swift presented the staff report. <br /> <br />Mayor Tarver declared the public heating open. <br /> <br /> Larry Dingman, 387 Sycamore Road, indicated he wanted the original Condition <br />#7 upheld which required planting screening trees on the western side. He stated a <br />concrete pad and shed were approved by the City without regard to Condition #7. He <br />said there was an agreement to install five 3-foot box trees on the western side. He has <br />tried to compromise, including agreeing to City-sponsored mediation. He urged Council <br />to retain Condition #7. <br /> <br /> Mayor Tarver indicated this has been going on for several years and there have <br />been several meetings to try to find a compromise. He asked Mr. Dingman if there had <br />been an agreeable solution at any time. <br /> <br /> Mr. Dingman said no. There had been quite a few plans and each one provided <br />less than the original condition. He was upset that the new plan does not include any <br />two- or three-foot box trees. <br /> <br />Ms. Michelotti asked if he had read all the material included in the staff report. <br /> <br />Mr. Dingman said he had. <br /> <br />Ms. Dennis inquired about how many Italian cypress trees were on his property. <br /> <br /> Mr. Dingman said there were 24 trees. He did not believe it mattered how many <br />trees were on his property; he wanted the original condition on the Keane approval <br />upheld. <br /> <br /> Earl Bach, 446 Sycamore Road, indicated he had first become acquainted with the <br />Dingmans when Mrs. Dingman complained about the light shining on the American flag <br />in front of his property. He related the ridiculous requests made by Mr. Dingman over <br />this long process and the many meetings the neighborhood has had to attend. He felt Mr. <br />Dingman was being paranoid and did not believe there was a mai privacy issue. He <br />urged Council to make a decision and let the Keanes get on with their lives. <br /> <br /> Jack Keane, 417 Sycamore Road, explained that he had made his presentation at <br />the last meeting and would not go over that again. He stated that his lot had been <br />approved for a house with a second story before Mr. Dingman moved into his home.
