He asked Council to remove Condition #7 entirely and deny the <br />appeal. <br /> <br /> Ms. Ayala asked if it were possible to work out the issues with Mr. Dingroan. <br />She asked if this issue had been put to rest a long time ago, would it have been better for <br />the whole neighborhood. <br /> <br /> Mr. Keane said it was not possible to work out the issue. Attempts have been <br />made over and over again. He agreed that a decision should have been made long ago <br />and this should never have gone to Council. <br /> <br />There being no further speakers, Mayor Tarver closed the public hearing. <br /> <br /> Ms. Dennis agreed with the staff recommendation except for planting more <br />cypress trees along the fence. She felt that would only invite more problems. She <br />indicated she had planted large box trees in her yard and they are all now dead. The ones <br />that did well and are still growing were 15 -gallon trees. Personally, she did not think that <br />planting any more trees would make any difference to the privacy, considering the <br />number of trees already there. <br /> <br /> It was moved by Ms. Dennis, seconded by Ms. Ayala, to approve staff <br />recommendation or to remove the condition for the trees, depending on what <br />Council would agree to. <br /> <br /> Mayor Tarver supported the staff recommendation. He believed the original <br />conditions should have been met, but in this case it is not the applicant' s fault they were <br />not. This situation has been going on too long and it is apparent that no plan will be <br />acceptable to Mr. Dingman. <br /> <br /> Ms. Michelotti also wanted to put this matter to rest. She indicated she had been <br />on both properties and observed the residence being built. She felt the staff <br />recommendation had some merit and agreed with requiring 15-gallon trees instead of the <br />larger ones. <br /> <br />Ms. Dennis withdrew her motion. <br /> <br /> It was moved by Ms. Ayala, seconded by Ms. Michelotti, to eliminate seven <br />cypress trees from the staff recommendation. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmembers Ayala and Michelotti <br />NOES: Councilmember Dennis and Mayor Tarver <br />ABSENT: Councilmember Pico <br />ABSTAIN: None <br /> <br />Pleasanton City Council 6 <br />Minutes <br /> <br />01/18/00 <br /> <br /> <br />
