denial of freedom of speech and an invasion of private property. He urged the City to <br />take action against the persons responsible. He cited recent hate crime incidents and felt <br />the preservation of freedom of speech was very important. He also objected to the <br />proposal to move the Meeting Open to the Public comments to the end of the agenda. <br />(He was assured that would not happen.) <br /> <br /> Kris Kumaran, 6450 Calle Esperanza, presented three points in favor of Measure <br />D. He believed there is a Council majority that continues to vote in favor of development <br />projects and residents have been forced to invoke the referendum process. The residents <br />have to deal with the impacts of traffic. school overcrowding. diminishing open space <br />and continual degradation of their quality of life. He believed the CAPP Initiative will <br />insure that the residents will have a say in the remaining 12% of open space in the city. <br />Secondly, he believed the basic arguments against the CAPP Initiative are fallacious. It <br />will not take away authority from the Planning Commission and City Council. He <br />believes Pleasanton has an informed electorate and can make informed decisions. The <br />CAPP Initiative insures that power rests with the people. It is no wonder anti-CAPP <br />spending exceeds $500.000. Thirdly, this Initiative will provide a different focus. He <br />believed approving more growth is like getting a new credit card to pay off an old one. <br />Existing residents have a fight to live. work and do business with uncongested roads. <br />The City Council and Planning Commission should focus on ways to mitigate growth <br />rather than add to it. We should focus on traffic mitigation measures; creating additional <br />open space: building an infrastructure that exceeds demands: ameliorate traffic noise: <br />reduce airport impacts by restricting building in certain corridors: and enforcing <br />restrictions on building on the ridge and protecting the environment. Seven thousand <br />residents helped put this Initiative on the ballot and he urged residents to join them and <br />vote yes on Measure D. <br /> <br /> Julie Testa. 3494 Torlano Court, requested an opportunity to discuss the audit <br />report of developer fees that was presented at the School Board meeting last Tuesday. <br />No questions or discussion were allowed at that meeting. After reviewing the audit. she <br />and other members of ROCA believe there are questions that need to be asked. She <br />realized this is a busy season and requested Council to put this on a future agenda for <br />discussion. She reminded Council the reason the audit was requested was to identify any <br />money that was unallocated for facilities. The ROCA group reviewed all documents that <br />were made available to them to try and find additional funds. In reviewing those <br />documents, multiple discrepancies were discovered and no answers to their questions <br />were forthcoming. At the last School Board meeting. it was stated the cost of the audit <br />was unreasonable and was taking funding from programs for the children. She also <br />stated her group had discovered a sum of $500~000 that was not collected from a <br />developer since 1995. They pointed this out to the District and that sum was collected. <br />She felt the $80.000 in interest on that sum far exceeds the cost of the audit. They think <br />the audit was money well-spent and there were many other discrepancies. Since the <br />Council/School Liaison Committee had agreed the audit could be funded out of the <br />developer fee fund. she asked that Council support that request.
