Mr. Roush stated that they are treated as members of the public because staff would not
Ms. Michelotti requested clarification of the original situation.

Marti Greist, 5470 Foothill Road, stated !that the lot line adjustment was processed

that the reduction of water to her resulted from corhstruction of the Joel/Greist holding tank and
pump upstream from her well. Ms. Greist has nol~ seen any hydrology studies that support this
belief. She believes there is plenty of water fromi the spring to serve both properties and Ms.
Greist and Mr. Joel have tried to work with Ms. 'Somnson to make sure she has had enough
water. She also disagreed with the statement that there is no water now. Ms. Greist indicated
there is water in the stream now, however she did agree the flow diminishes considerably in the
summer, but an adequate holding tank solves the summer problems. Ms. Gmist indicated water
law is very clear in the State of California and She believe the City is setting a dangerous
precedent by taking responsibility for the maintenance of her pump.

Ms. Mohr asked if Mr. Garms, the original owner of the property, used the same source
for water for his family and ranch.

Ms. Greist indicated it was the same; holyever they switched to City water for the
residence and the spring was used for irrigation orfly.

Ms. Dennis asked how Ms. Greist knew When she had reached the 500 gallon per day
limit.

Ms. Grcist indicated their tank holds approximately that amount aud they pump only once
a day in the morning. There are other holding tanks on the property to save unused water. She
reiterated her belief that there is enough water in the spring to serve both properties. Ms. Gmist
strongly opposed the City taking responsibility for: the Sorenson water pump.

Ms. Sorenson stated she had never shared Water with the Garms in the 22 years she has
lived on her properly. She has not checked the st~ring since Thanksgiving day, but stated she
has not had water since that time. She did not believe there was enough water to share with Ms.
Greist and indicated they are using more water than previously due to additional trees and
landscaping.

12/13/94

Page
