The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Michelotti, Mohr, and Mayor Tarvet <br />NOES: Councilmember Pico <br />ABSENT: None <br />ABSTAIN: None <br /> <br />MATTERS CONTINUED FOR DECISION <br /> <br />Item 10c <br />Consideration of maintenance and ownership responsibilities for the water line to Anne <br />Sorenson's property (SR 94:412) <br /> <br />Randall Lum presented the staff report. <br /> <br /> Anne Sorenson, 4432 Foothill Road, indicated she did not agree with the staff <br />recommendation and objected to various matters in the staff report. She explained that she did <br />not ask for the City to pay for the water to her property. She stated that she was never involved <br />in any discussions regarding the agreement with Greystone Homes and the Park District. Ms. <br />Sorenson disagreed that Mr. Joel had never been found in violation of the 500 gallon per day <br />pumping limit. She also referred to the lot line adjustment and complained about not being <br />notified. A neighbor, David Glenn, knew about the action and his property is farther away than <br />hers. She indicated that the Planning Director knew she got her water from the spring and she <br />should have been notified. Her request is that the City maintain the system that is being <br />installed and that the City pays for the electricity to pump water to her tank. She reiterated her <br />contention that no one has every consulted her on this situation and she has never had an <br />opportunity to confer with her own attorney on any agreements. Finally, she indicated the water <br />level is so low now that she has no water to her residence and she has been unable to live there <br />for a couple of months. <br /> <br /> Ms. Michelotti remembered testimony from last February, and asked if A-M Homes <br />constructed a water line to her property. <br /> <br /> Ms. Sorenson indicated it had, but no water has flowed through it because of the need <br />to relocate the pump station. <br /> <br /> Ms. Dennis agreed that Ms. Sorenson was not involved in discussions regarding bringing <br />the water line to her house. Ms. Dennis had been primarily concerned that there be water to <br />her house if the situation with the spring could not be resolved. Ms. Dennis asked for <br />clarification of noticing procedures to individuals that have an easement on a particular property. <br /> <br />12/13/94 <br /> <br />Page 4 <br /> <br /> <br />
