6. MATTERS CONTINUED OF DECISION <br /> <br />Item 6a <br />Ordinance No. 1639. an ordinance aoprovina the application of Caffino. Inc. for a major <br />modification to allow a drive-throuah. take-out use at Pleasant Villaae Center. as filed <br />under Case PUD-80-15-SD-4M. <br /> <br /> It was moved by Ms. Mohr, seconded by Ms. Scribner, to adopt Ordinance No. 1639, <br />approving the application of Caffino, Inc. for a major modification to allow a drive-through, <br />take-out use at Pleasant Village Center, as filed under Case PUD-80-15-SD-4M. <br />The roll call vote was as follows: <br />AYES: Councilmembers - Dennis, Mohr, Scribner, and Mayor Tarver <br />NOES: None <br />ABSENT: Councilmember Pico <br />ABSTAIN: None <br /> <br />Item 6b <br />Review of Viacom Cable TV rates for basic cable service from 9/1/93 to 7/14/94 <br />(SR 94:340) <br /> <br /> Chris Sherwood presented the staff report recommending that Council order a rate <br />reduction for basic service and directing staff to pursue a request for clarification from the FCC <br />on the channel counting issue. <br /> <br />Council discussed how rates are set for the premium channels. <br /> <br /> Mr. Sherwood indicated the rams for the premium channels are not set by the FCC. It <br />is a free market enterprise. <br /> <br /> Wayne Strickler, 891 Independence Court, supported the staff position. He stated the <br />charge for cable television in Pleasanton is $36.16 for 32 channels including HBO. In <br />Scottsdale, Arizona, his basic plus rate is $18.56 for 53 channels. He took exception to the <br />statements of Sue Levitin at the last Council meeting regarding fiber optics testing in Castro <br />Valley and the desire of Viacorn to find out what people want. He indicated fiber optics is a <br />known technology and it is obvious people want more channels at a reduced rate. He further <br />stated that he had communicated with the FCC and was told that QVC (home shopping), MTV, <br />and two others are not broadcast channels and Viacom is under no obligation to carry them. <br /> <br /> Angelina Summers, 4750 Sutter Gate Avenue, suggested the Tri-Valley cities purchase <br />a joint receiving dish for television.
