Chris Miller, 663 Romeo Court, inquired about the construction on Sunol
Boulevard from Diamond Court to Sonoma Drive. He was concerned about when it
would be completed.

Mr. Lum said the developer is proceeding to complete the work and that he would
advise Mr. Miller of the schedule.

Cheryle Muller, 3236 Omega Circle, referred to the Fire Department's denial of a
permit to erect a large tent on the street for a New Year' s Eve block party. She related
the plans she has made for the event. She did not believe there were any safety issues to
justify denial of the permit. She referred to Main Street closures and the tents where
cooking occurs, which would be more a problem than the event she is planning.

Fire Chief Stewart Gary indicated this is a 30x70 foot tent with roof, walls and
heating facilities. A tent this size would effectively close the street and block access to
one or two houses. The Fire Department policy on special events has always been to
allow movable blockages such as tables and chairs or barricades, but not large immovable
objects that block access. The downtown events are on wider streets and fire trucks can
still get through. There are inspections prior to the events and frequently standby units at
the downtown events. He indicated staff has tried to work with the applicant to use
several smaller tents that trucks can maneuver around. He indicated he had spoken to the
rental company which had agreed to refund the entire deposit if it is done by noon
tomorrow.

Mayor Tarver asked if the parking lot on Parkside Drive had been considered for
the tent location.

Fire Inspector Scott Deaver indicated that using the parking lot had been
discussed with Ms. Muller and she expressed concem that the Parks and Community
Services Department would not grant a permit because it did not allow alcohol on that
site and that no permits were being granted for New Year' s Eve.

Ms. Michelotti inquired if the Parkside Drive location was wider than Omega
Circle.

Ms. Muller said the streets were the same, but she did not feel there was any
blockage and the Fire Department could have access to all the houses.

Chief Gary indicated all other permits for tents that block street access had been
denied in Pleasanton and Livermore and he felt he should be consistent on this
application. The tent as proposed would block fire access to two homes. If this were to
be allowed, he would request a waiver from the homeowners and their insurance
companies. He reiterated that smaller tents would be allowed or tents situated on part of
the street and part of the yards. The principal reason for denial is the size of the tent and

Pleasanton City Council 3 11/09/99
Minutes
