361 <br /> <br /> Mr. Raymond Baker, the attorney representing Mr. and Mrs. John Shaw, 0~ers of <br />the Pastime Pool, explained the activities of their card room. He stated that his <br />clients were iu favor of the ordinance excepting they felt that if their card rooms <br />were to be restricted, card playing for many iu social clubs should also be <br />stricted. They also objected to the amortization of their business. <br /> Several retired women stated that because of there being uo other form of enter- <br />tainment in Pleasanton, they frequented Pastime Pool and spent many enjoyable hours <br />p!ayiug cards. <br /> Mr. Mark Van Loucks, 78 Castlewood Drive, gave an interesting desertation ou the <br />social and psychological benefit to businessmen ~ho are under strain and tension <br />during their work day. Mr. Van Loucks also stated that there were many patrons of <br />Pastime Pool who played poker for sheer entertainment, and he had never witnessed <br />any trouble iu this establishment. <br /> Police Chief Walter McCloud recommended that the card rooms be closed at 2:00 AM <br />and be completely phased out within two years. He argued that the all night opera- <br />ttous necessitated additional police patrols as it invited professional gamblers <br />from other areas. <br />Hr. Robert Clauser, 4340 Railroad Avenue, 0vmer of the Green Door, objected to <br />the proposed 2:00 AM closing time, and to the phasing out of these establishments. <br /> There being no further public protests, it was moved by Councilman Spiliotopoulos <br />and seconded by Councilman Reid that the public hearing be closed. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis,"Retd, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Rega <br /> <br /> After considerahle discussion by the Councilmen, it was moved by Councilman <br />Spiliotopoulos and seconded by Councilman Betatits, that Ordinance No. 554, regula- <br />ting card rooms, card tables and their use for gambling, and deleting the section <br />regarding amortization of existing card rooms, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Rega <br /> <br />Mayor Gerton recessed the meeting at 9:40 P.M. <br /> <br />Hayor Getton reconvened the meeting at 10:00 P.M. <br /> <br />PUBLIC ~FARINGS.,.Continued <br />~,eal of Mr. Geor~ O~kes~ Amador Valley Investors~ from a condition..aDplied b-Y_ .._ <br />ti~c PlsnninM Commission to the application of Humble Oil Co.,.for a ~onditional <br />Use Permit in order to construct an automobile service station at the southeast <br />corner of W. Las Posita~ Blvd.~ and Santa Rita Road~ in a C-N District; said con- <br />d_jtio____n_~_p2cifying that said service station cannot be constructed until 25% of the <br />surrounding and adjacent neighborhood shoppin~ center is constructed Mayor Gerton declared the public hearing open. <br /> Mr. Castro explained that it is the intent of the Planning Commission in <br />attsching this condition was to enable the Commission to relate the service <br />station to the proposed shopping center insolaf as circulation patterns, archi- <br />tectural elevations and landscaped areas are concerned. <br /> Mr. George Oakes presented a sketch of the proposed service station and stated <br />that the entire shopping center would be built with the same architectural design. <br />Mr. Oakes protested the restriction based on the completion of 25% of the shopping <br />center. He claimed that the 300 existing homes in his subdivision made it <br />economically feasible to construct the service station at this time. <br /> Mr. Castro stated that the Planning Commission had approved the use of the <br />corner area for a service station but until the precise plan for the buildings <br />within the Center itself were approved, the Commission might want to reverse the <br />location of the gasoline pumps and building in order to allow proper egress and <br />ingres~ to the station. <br /> There being no other public protest on the entire matter, it was moved by <br />Councilman Spiliotopoulos and seconded by Councilman Beratlis that the public <br />hearing be closed. <br />The roll call vote was as follows: <br />AYES: Councilmen Betatits, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Rega <br /> <br /> After considerable discussion, the City Attorney was instructed to review the <br />entire matter and give his opinion next week on whether the condition applied to <br />Conditional Use Permit No. 69-7, Humble Oil Company, is legal. <br /> <br /> 2. <br /> <br /> <br />
