AbandOrup. ent of ~ portion o.~ Black Avenue, adjaCen~ on the east .to.~opVard RO~d, t~ <br />D & V Builders~ Inc.~ pursuant to ResOlution of Intention No. 69-3~ adopted <br />January 13~ 1969 <br /> Mayor Getton declared the public hearing open. <br /> There being no public protest, it was moved by Councilman Beratlis and seconded <br />by Councilman Reid that the Public Hearing be closed. <br />The roll call yore.was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilman Beratlis and seconded by Councilman Reid that <br />Resolution No. 69-21, abandoning a portion of Black Avenue on the east to Hopyard <br />Road, to D&V Builders, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters to be continued for discussion. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Report of the Plannin~ Commission R.e: ~pplication of D&V Builders for preliminarl <br />approval under P.U.D. reMulations in order to allow the construction of a 72-unit <br />g_arden apartment complex in an RM-25 District located at the northeast corner of <br />Black Avenue and Hopyard Road <br /> Mr. Castro presented maps which revealed the Y2-unit garden apartment complex. <br />Mr. Castro reported that preliminary approval under P.U.D. regulations is necessary <br />by the Council. <br /> It was moved by Councilman Spiliotopoulos and seconded by Councilman Beratlis <br />that Resolution No. 69-22, granting preliminary approval of the application of <br />D&V Builders, Inc., under P.U.D. regulations, for the construction of a 72-unit <br />garden apartment complex in an RM-25 District located at the northeast corner of <br />Black Avenue and Hopyard Road, with the following change in the plan as submitted: <br /> 1. The proposed two-story unit to be located immediately adjacent to <br /> the intersection of Black Avenue and Hopyard Road should be moved <br /> to an alternate location within the complex, and a single-story <br /> unit inserted in its place, <br /> be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Getton <br />NOES: None <br />ABSENT: None <br /> <br /> Report of the Planning Commission Re: City Council referral of the ~.Dpeal of E. G. <br /> ~[ai~,.,3435 Mr. Diablo Blvd.~ Lafayette, for qualified Investors, Inc.~ from an <br /> adverse decision of the Planning Commission in denying an application to rezone <br /> from the A District to the C-N~ P and O Districts ~pproximately 5.2 acres at the <br /> southwest corner of Hopyard Road and Las Positas Blvd. <br /> Mr. Fales reported that the Public Hearing on the above matter was closed and <br /> the appeal was referred to the Planning Commission again for further study. <br /> Mr. Castro stated that a considerable amount of discussion on this matter <br />ensued at the Planning Commission meeting which concluded in that Commission re- <br />affirming their previous position of denying the application. <br /> After lengthy Council discussion, it was moved by Councilman Reid and seconded <br />by Councilman Rega, that Resolution No. 69-23, denying the application of Mr. E. <br />G. Craig, to fezone from the "A" District to the C-N, P, and O Districts at the <br />southwest corner of Hopyard Road and Las Positas Blvd., be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Rega, Reid and Mayor Gerton <br />NOES: Councilmen Beratlis and Spiliotopoulos <br />ABSENT: None <br /> <br /> Mayor Gerton invited Mr. Craig to present another plan for this area as he <br /> felt that with some modification, a compatible land use could be reached. <br /> <br /> <br />
