The roll call vote was as follows: AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton NOES: None ABSENT: None MATTERS CONTINUED FOR DECISION There were no matters to be continued for discussion. REPORTS OF BOARDS AND COMMISSIONS Report of the Plannin~ Commission R.e: ~pplication of D&V Builders for preliminarl approval under P.U.D. reMulations in order to allow the construction of a 72-unit g_arden apartment complex in an RM-25 District located at the northeast corner of Black Avenue and Hopyard Road Mr. Castro presented maps which revealed the Y2-unit garden apartment complex. Mr. Castro reported that preliminary approval under P.U.D. regulations is necessary by the Council. It was moved by Councilman Spiliotopoulos and seconded by Councilman Beratlis that Resolution No. 69-22, granting preliminary approval of the application of D&V Builders, Inc., under P.U.D. regulations, for the construction of a 72-unit garden apartment complex in an RM-25 District located at the northeast corner of Black Avenue and Hopyard Road, with the following change in the plan as submitted: 1. The proposed two-story unit to be located immediately adjacent to the intersection of Black Avenue and Hopyard Road should be moved to an alternate location within the complex, and a single-story unit inserted in its place, be adopted. The roll call vote was as follows: AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Getton NOES: None ABSENT: None Report of the Planning Commission Re: City Council referral of the ~.Dpeal of E. G. ~[ai~,.,3435 Mr. Diablo Blvd.~ Lafayette, for qualified Investors, Inc.~ from an adverse decision of the Planning Commission in denying an application to rezone from the A District to the C-N~ P and O Districts ~pproximately 5.2 acres at the southwest corner of Hopyard Road and Las Positas Blvd. Mr. Fales reported that the Public Hearing on the above matter was closed and the appeal was referred to the Planning Commission again for further study. Mr. Castro stated that a considerable amount of discussion on this matter ensued at the Planning Commission meeting which concluded in that Commission re- affirming their previous position of denying the application. After lengthy Council discussion, it was moved by Councilman Reid and seconded by Councilman Rega, that Resolution No. 69-23, denying the application of Mr. E. G. Craig, to fezone from the "A" District to the C-N, P, and O Districts at the southwest corner of Hopyard Road and Las Positas Blvd., be adopted. The roll call vote was as follows: AYES: Councilmen Rega, Reid and Mayor Gerton NOES: Councilmen Beratlis and Spiliotopoulos ABSENT: None Mayor Gerton invited Mr. Craig to present another plan for this area as he felt that with some modification, a compatible land use could be reached.
