Ruth and Assoc. from an adverse decision of the PlaBnin~ <br />Commission Re: PUD 69-6 (Rosepointe) <br />Mr. Edgar announced that he had receiVEd a letter from Mr. Ruth Which requested <br />that the Rosepointe P.U.D. be returned to the Planning Commission for consideration <br />of alternate plans and that the public hearing on the appeal not be held. <br />It was moved by Councilman Spi1iotopoulos and seconded by Councilman Rega that <br />the appeal of Mr. Herman D. Ruth and Associates from an adverse decision of the <br />Planning Commission on Rosepointe PUD-69-6, be referred back to the Planning Com- <br />mission in order that that Commission may review alternate plans. <br />Tb~ roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega. Johnson, Jr., American Forest Products Corp., from an adve!E~ <br />decision of the Planning Commission Re: rezoning applica~ <br />It was moved by Councilman Rega and seconded by Councilman Reid that the Public <br />Hearing be declared open. <br />Mr. Edgar reported that a letter, dated October 21, 1969, from the Pleasanton <br />Chamber of Commerce, which stated that the Central Business District Committee and <br />the Corrmercial Development Committee studied the application of Mr. W. D. Johnson, <br />Jr., for the rezoning of the subject 7~ acre parcel. from Agriculture to Commercial <br />and opposed this rezoning by unanimous vote. <br />Mr. Edgar also reported that the report of the Planning Director, dated October <br />23, 1969, which stated that it was the Planning Commission's desire that a communi- <br />cation be forwarded to the City Council requesting that all applications that are <br />affected by Annexation #49 and fronting on Santa Rita Road be considered together <br />rather than considering them individually. <br />Mr. John Corley. Attorney representing Mr. Johnson. stated that it is Mr. John- <br />son's intent to amend the application after discussing the matter with the staff. <br />Councilman Spiliotopoulos suggested that the members of the Chamber of Commerce <br />Central Business District Committee that are present, be allowed to discuss their <br />viewpoints with the City Council. Mayor Gerton stated that this can be done after <br />the Planning Commission has reviewed all the applications involved in this matter. <br />After some discussion regarding the zon:i.ng on this property. Councilman Reid <br />moved a substitute motion which was seconde:d by Councilman Beratlis that the appeal <br />of Mr. W. D. Johnson, Jr., American Forest Products Corporation, from an adverse <br />decision of the Planning Commission regarding a zoning application be referred back <br />to the Planning Commission in order that that Commission may consider all applica- <br />tions for rezoning that are affected by Annexation No. 49 and fronting on Santa <br />Rita Road, at one time. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br /> <br />g~solution of the City Council declaring a public nuisance of rubbish on property <br />at 24 Happy Valley Road in pleasanton <br />Mr. Edgar stated that he had received a telephone call from Mr. Lee Amaral, <br />Attorney for Mr. William Marsh. owner of the property at 24 Happy Valley Road, <br />stating that the clearing of the property Which is creating a public nuisance <br />will be accomplished next week and therefore, requested that this public hearing <br />be continued on November 10, 1969. <br />It was moved by Councilman Rega and seconded by Councilman Reid that the public <br />hearing in the matter of declaring a public nuisance of rubbish on the property at <br />24 Happy Valley Road, Pleasanton, be continued at 8:00 P.M., on November 10. 1969. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, Spiliotopoulos and Mayor Gerton <br />NOES: None <br />ABSENT: None <br /> <br />MATTR~S CONTINUED FOR DECISION <br />There were no matters to be continued for decision. <br /> <br />SPECIAL REPORTS <br />There were no Special Reports scheduled for this meeting. <br /> <br />3. <br />
