Matters for the Information of the Council <br /> Mr. Fales reported that a copy of a letter from Mr. Earl Mason, President of <br /> the Livermore Chamber of Commerce, advising that the California Environmental <br /> Quality Study Council will hold its eight~ hearing on March 7th at 9:30 A.M. at <br /> St. Charles Barromeo Catholic Church, 1315 Lomitas Avenue in Livermore, was for- <br /> warded to the Council. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> There were no reports from the City Attorney. <br /> <br /> COMMUNICATIONS <br /> From Ted C. Fairfi~eld~..MaCKaY and Somps~ Re: ReqUesT for C-N Zoning in the Arroyo <br /> del Prado Subdivision <br /> Mr. Fales reviewed the letter from Mr. Ted Fairfield, dated February 12, 1970, <br /> which outlined the action taken on the entire 475 acre project since the Planned <br /> Unit Development was approved in November, 1967. <br /> Mr. Fales stated that this PUD permit, as originally approved, has a life of <br /> 8 years, commencing in November, 1967, and specifically approves the C-N land use, <br /> subject to the full site plan and architectural control procedures and to a re- <br /> struction that a center cannot be constructed until 500 holes are occupied in the <br /> project. Mr. Fales stated that no reference to an anchor tenant was in the <br /> approved PUD permit. <br /> Mr. Fales explained why he felt that the '~500 homes" condition was not rele- <br /> vent at the present time. <br /> Mr. Fairfield displayed maps of the subject area and explained that this <br /> Neighborhood Shopping Center is in a very logical location. Mr. Fairfield also <br /> stressed the fact that the original PUD permit made no reference to an "anchor <br /> tenant". <br /> Councilman Reid stated that the action taken by the City Council on February <br /> 9, 1970, did not disapprove the C-N designation. He stated that it was referred <br /> to the Planning Commission for re-evaluation as to size, uses, consideration of <br /> securing an anchor tenant to assure its being a vital center and also, if the size <br /> is too large, that landscaping be used. <br /> Mr. Fairfield suggested that this matter be removed from the planning Commis- <br /> sion's consideration and the City Council reschedule a public hearing. <br /> After considerable discussion, it was moved by Councilman Reid and seconded by <br /> Councilman Beratlis that the Planning Commission, in addition to the City Council's <br /> instructions of February 9, 1970, regarding the C-N zoning in the Arroyo del Prado <br /> Subdivision, be instructed to eliminate the condition regarding the occupancy of <br /> 500 homes. <br /> The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Spiliotopoulos <br /> <br /> From Dr. Howard Long Re: Commendation for Chief Walter McCloud <br /> Mr. Fales stated that this letter commending the Chief of Police and his de- <br /> partment had been forwarded to the City Council. <br /> <br />From Mrs. G. Keith James Re: Closin~ of Abbie Street <br /> Councilman Rega explained the auto-train accident at the Southern Pacific <br />crossing at Abbie Street. <br /> Discussion ensued regarding the status of signalizing this crossing and Mr. <br />Campbell reported that funds have been budgeted for this work and the staff is <br />proceeding as fast as possible in their negotiations with Southern Pacific Company. <br /> <br />MATTERS INITIATED BY COUNCIL MEMBERS <br /> Councilman Rega requested a staff report on the possibilities of a bond issue <br />election to finance the sewer expansion of the VCSD plant in order to phase-out <br />the City's treatment plant. Councilman Rega cited the capacity situation at the <br />Sunol Boulevard plant. <br /> Councilman Reid stated he was opposed to bond issues to solve every problem <br />and questioned the legality of Councilman Rega's suggestion. <br /> Mayor Gerton suggested that this be discussed after the April 14th Municipal <br />Election as he felt this was a political matter. <br /> <br /> <br />
