In view of Mr. Fales' remarks under Agenda Amendments, regarding Mr. Ruth's <br />request for a continuance of this public hearing until March 16, 1970, Mayor <br />Gerton asked for discussion at Council level. <br /> Councilman Rega stated that the people who reside in the subject area have <br />hired an attorney and he suggested that the matter of continuance be discussed <br />with him. <br /> Mr. Lee Amaral, representing some of the residents in this area, stated he had <br />no objection to this public hearing being postponed until March 16, 1970. Mr. <br />Amaral made reference to the Council's decision regarding the postponing of all <br />rezoning that would increase density, until after the discussions on the petition <br />to declare a moratorium on rezoning, had been held. <br /> It was moved by Councilman Rega and seconded by Mayor Gerton to continue the <br />Public Hearing on the appeal of Mr. Ruth until March 16, 1970. <br /> Councilman Reid stated that Mr. Ruth had offered no valid reason for his ab- <br />sence at this scheduled hearing and stated he was ready to vote on this matter <br />tonight. <br /> Mr. Hirst reported that the City Council was not legally obligated to grant <br />Mr. Ruth's request for continuance, but as a matter of courtesy, he would recommend <br />that this be postponed until March 9, 1970. <br /> It was moved by Councilman Reid and seconded by Councilman Beratlis that a <br />substitute motion to continue the public hearing on the appeal of Mr. Ruth, to <br />March 9, 1970, and that Mr. Ruth be instructed that the City Council will make a <br />decision on his appeal whether or not he is present at the public hearing. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Spiliotopoulos <br /> <br />MATTERS CONTINUED FOR DECISION <br /> There were no matters to be continued for decision scheduled for this meeting. <br /> <br />SPECIAL REPORTS <br /> There were no special reports scheduled for this meeting. <br /> <br />REPORTS OF BOARDS AND COM~SSIONS <br />Report of the Planning Commission Re: Review of Revised Plans for Six-plexes <br />~Amador Valley Investors) <br /> Mr. Fales stated that a report, dated February 13, 1970, from the Planning <br />Director and copies of the Minutes of the Special Meeting of the Design Review <br />Board held on February 10, 1970, had been forwarded for the Council's information. <br /> <br />REPORTS OF THE CITY MANAGER <br />Report of the Assistant.City Manager .Re: Purchase of Patrol Cars through Alameda <br />CoUP~Y <br /> Mr. Edgar reviewed his report dated February 10, 1970, which outlined the cost <br />comparisons by going to bid locally or purchasing Patrol Cars through Alameda <br />County. <br /> In view of the savings of $568.19, Mr. Edgar recommended that the City Council <br />authorize the staff to purchase the two replacement patrol cars, which are current- <br />ly budgeted through Alameda County rather than advertize for bids locally. <br /> After some discussion, it was moved by Councilman Reid and seconded by Council- <br />man Beratlis that Resolution No. 70-36, approving the purchase of two Police Patrol <br />Cars through Alameda County and/or the State of California, be adopted. <br />The roll call vote wa~ as follows: <br />AYES: Councilmen Beratlis, Rega, Reid, and Mayor Getton <br />NOES: None <br />ABSENT: Councilman Spiliotopoulos <br /> <br />Approval of Agreement with B.A.R.T.D. Re: Intra-Valley Transportation Study <br /> Mr. Fales recommended approval of the Joint Exercise of Powers Agreement with <br />Bay Area Rapid Transit District regarding the Intra-Valley Transportation Study <br />and called the Council's attention to the fact that the City Council should also <br />designate an authorized Board of Control member. <br /> It was moved by Councilman Reid and seconded by Councilman Rega that Resolu- <br />tion No. 70-37, approving the Joint Exercise of Powers Agreement with Bay Area <br />Rapid Transit District for a bus transit study within the Livermore-Amador Valley, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Beratlis, Rega, Reid and Mayor Gerton <br />NOES: None <br />ABSENT: Councilman Spiliotopoulos <br /> <br /> 2. <br /> <br /> <br />
