P~PORTS OF TtIE CITY ATTORNEY Report on the Park Dedication Case. Mr. Hirst reviewed his report, dated April 30, 1971, which stated that on April 26, 1971, the State Supreme Court rendered its unan- imous opinion ruling that cities and counties may require subdividers to dedicate land or pay fees in lieu of, for parks. Mr. Hirst advised the Council that a 30 day ~,.~aiting period whould be observed before the park fees, which the City of Pleasanton has held, be spent on the parks. It was moved by Mayor Reid and seconded by Councilman Gerton that Resolution No. 71-99, commending the City of Walnut Creek, the Walnut Creek City Attorney Dan Curtin , the Livermore City Attorney A1 Lewis and the City of Pleasanton City Attorney William Hirst, for the suc- essful prosecution of the Supreme Court Case involving the challenge to the Walnut Creek Park Dedication Ordinance, be adopted. The roll call vote was as follows: 4 AYES: Councilmen Beratlis, Gerton, Pearson, Spiliotopoulos and NOES: None Mayor Reid ABSENT: None Report and proposed Ordinance reqardin~ the removal of abandoned vehicles from private property. Mr. Hirst reviewed his report regarding the removal of abandoned vehicles, dated April 30, 1971, and recommended the immediate intro- duction of an ordinance amending the Abandoned Vehicle Ordinance in order that the provisions which streamline the existing provisions may become effective within the City as soon as possible. It was moved by Councilman Gerton and seconded by Councilman Beratlis that Ordinance No. 630, amending Article 1 of Chapter VII of Title V of the Ordinance Code of the City of Pleasanton relating to the abatement and removal as a public nuisance of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof,from private property or public property, not including highways, and the recov- ery of costs of administration thereof, be introduced. The roll call vote was as follows: AYES: Councilmen Beratlis, GertOn, Pearson, Spiliotopoulos NOES: None and Mayor Reid ABSENT: None Report on Environmental Problems Mr. Hirst reviewed his report on Environmental Impact Legislation, dated April 30, 1971. After some discussion the City Council requested that an Environmen- tal Impact Section be drafted for t~eir review, for possible insert- ion into the C_ity Zoning Ordinance.
