A copy of an informational paper from the Director of F, ecrea- <br /> tion. <br /> <br />P~PORTS OF TtIE CITY ATTORNEY <br /> <br />Report on the Park Dedication Case. <br /> <br />Mr. Hirst reviewed his report, dated April 30, 1971, which stated <br />that on April 26, 1971, the State Supreme Court rendered its unan- <br />imous opinion ruling that cities and counties may require subdividers <br />to dedicate land or pay fees in lieu of, for parks. <br /> <br />Mr. Hirst advised the Council that a 30 day ~,.~aiting period whould be <br />observed before the park fees, which the City of Pleasanton has held, <br />be spent on the parks. <br /> <br />It was moved by Mayor Reid and seconded by Councilman Gerton that <br />Resolution No. 71-99, commending the City of Walnut Creek, the Walnut <br />Creek City Attorney Dan Curtin , the Livermore City Attorney A1 Lewis <br />and the City of Pleasanton City Attorney William Hirst, for the suc- <br />essful prosecution of the Supreme Court Case involving the challenge <br />to the Walnut Creek Park Dedication Ordinance, be adopted. <br /> <br />The roll call vote was as follows: <br /> 4 <br /> <br />AYES: Councilmen Beratlis, Gerton, Pearson, Spiliotopoulos and <br />NOES: None Mayor Reid <br />ABSENT: None <br /> <br />Report and proposed Ordinance reqardin~ the removal of abandoned <br />vehicles from private property. <br /> <br />Mr. Hirst reviewed his report regarding the removal of abandoned <br />vehicles, dated April 30, 1971, and recommended the immediate intro- <br />duction of an ordinance amending the Abandoned Vehicle Ordinance in <br />order that the provisions which streamline the existing provisions <br />may become effective within the City as soon as possible. <br /> <br />It was moved by Councilman Gerton and seconded by Councilman Beratlis <br />that Ordinance No. 630, amending Article 1 of Chapter VII of Title <br />V of the Ordinance Code of the City of Pleasanton relating to the <br />abatement and removal as a public nuisance of abandoned, wrecked, <br />dismantled or inoperative vehicles or parts thereof,from private <br />property or public property, not including highways, and the recov- <br />ery of costs of administration thereof, be introduced. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, GertOn, Pearson, Spiliotopoulos <br />NOES: None and Mayor Reid <br />ABSENT: None <br /> <br />Report on Environmental Problems <br /> <br />Mr. Hirst reviewed his report on Environmental Impact Legislation, <br />dated April 30, 1971. <br /> <br />After some discussion the City Council requested that an Environmen- <br />tal Impact Section be drafted for t~eir review, for possible insert- <br />ion into the C_ity Zoning Ordinance. The Council also requested t~hat <br />a study session with the Planning Commission be scheduled when the <br />draft is ready to be considered. <br /> <br /> 4. 5-3-71 <br /> <br /> <br />
