26.9 <br /> <br />A representative of MacKay Homes showed slides depicting the proto- <br />type of this project. <br /> <br />There being no majority protests, it was moved by Councilman Beratlis <br />and seconded by Councllman Spiliotopoulos that the public hearing <br />be closed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Pearson, Spiliotopoulos and <br /> Mayor Reid <br />NOES: None <br />ABSENT: None <br /> <br />Councilman Pearson stated his opposition to increasing density. <br /> <br />It was moved by Councilman Spiliotopoulos and seconded by Councilman <br />Beratlis that Resolution No. 71-8, approving the final development <br />plan of MacKay itomes regarding Planned Unit Development No. 69-7, a <br />patio-house development to be located on the southeasterly side of <br />Hopyard Road, east of Tract No. 3048 and containing approximately 16 <br />acres, be adopted. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Spiliotopoulos and Mayor Reid <br />NOES: Councilman Pearson <br />ABSENT: None <br /> <br />It was moved by Councilman Spiliotopoulos and seconded by Councilman <br />Beratlis that Ordinance No. 622, amending Ordinance No. 520, in order <br />to apply zoning districts to the area of PUD 69-7, in accordance with <br />the approved final development plan, be introduced. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Spiliotopoulos and Mayor Reid <br />NOES: Councilman Pearson <br />ABSENT: None <br /> <br />Receipt and Consideration of Public Protests Re: Annexation No. 59, <br />~Ieadowlark Dairy <br /> <br />Mr. Fales stated that he had received a letter, dated December 28, 1970 <br />from Mr. Carl R.. Munsey, Area Manager, Northern California, for the <br />Great Southwest Corporation, requesting an additional 120 days post- <br />ponement of the Public Hearing on Annexation No. 59. <br /> <br />Mr. Fales reported that because, at this point, these annexation pro- <br />ceedings would have to be reinitiated with the Local Agency Formation <br />Commission, he would recommended that Mr. Munsey's request be denied <br />and the proposed annexation be dismissed. Mr. Fales stated that he <br />would communicate with Mr. Munsey and ask him to submit another <br />application to annex the subject property. <br /> <br />It was moved By Councilman Spiliotopoulos and seconded by Councilman <br />Beratlis that Annexation ~]o. 59 proceedings, be dismissed. <br /> <br />The roll call vote was as follows: <br /> <br />AYES: Councilmen Beratlis, Gerton, Pearson, Spiliotopoulos and <br /> Mayor Reid <br />NOES: None <br />ABSr]ET: None <br /> <br /> 4 ~ 1-4-71 <br /> <br /> <br />
