The roll call vote was as follows: AYES: Councilmen Beratlis, Pearson, Spiliotopoulos and Mayor Reid NOES: None ABSENT: Councilman Gerton PUBLIC HEARINGS Consideration of the extension of the appropriate provisions of Ord- inance No. 637 (Foothill Road Interim Zoning) in order to allow suffi- cient time to process final zoning solution for the property before Planning ~ommission and City"Coun~l ............ Mayor Reid declared the public hearing open. Mr. Edgar reported that he, Mayor Reid, the R.F.D. Committee and repre- sentatives from Castlewood Enterprises had been working together to arrive at a solution to the Foothill Road zoning. Mayor Reid read his statement, dated October 4, 1971, regarding this solution which reported that the following proposal has been agreed upon by both the property owners and the interested persons involved in this issue: 1. The property be zoned R-1 10,000 2. The precise zoning be overlayed with the R-O District which pro- vides: a. Average lot size of 12,000 square feet b. Density of 2.8 c. Side yards of 23 feet total with 18 feet on one side 3. The finding that multiple zoning would not be permitted' on the p rope rty. Mayor Reid also recommended that the City Council take the following action: 1. Refer this matter to the Planning Commission with the instruct- ion that the Planning Commission recommend to the City Council that the property be rezoned in accordance with the above proposal. 2. Extend the Study District for this property to November 8, 1971. 3. Process this application in time to allow adoption of an ordin- ance on November 8, 1971. Mr. Russell Roessler, attorney for Castlewood Enterprises, stated that he and Mr. Ebert were not under the impression when they left the meet- ing with Mr. Edgar, the Mayor, and other interested parties, that any agreement to this matter had been reached. He said that the conditions cited by Mayor Reid would be explored, but Castlewood Enterprises was not in agreement with this and that a Tentative Site Plan to develop part of the property has been filed with the City. Mr. Roessler fur- ther stated that 2.8 units per acre was no compromise and that he is reserving Castlewood Enterprises' right to resort to any legal action they might have but they do not agree to this proposal. Mr. Ed McDonald, chairman of the R.F.D. Committee, who was present at the negotiations, stated that it was his understanding that the pro- posal was agreeable with Mr. Roessler. After considerable disc,~sion on this matter, Councilman Spiliotopoulos and Councilman Beratlis stated that they were not prepared to vote on Mayor° Reid's proposal and asked that this issue be postponed until next weeks ' meeting. 2. 10-4-71
