The roll call vote was as follows: <br /> <br /> AYES: Councilmen Beratlis, Pearson, Spiliotopoulos and Mayor Reid <br /> NOES: None <br /> ABSENT: Councilman Gerton <br /> <br /> PUBLIC HEARINGS <br /> <br /> Consideration of the extension of the appropriate provisions of Ord- <br /> inance No. 637 (Foothill Road Interim Zoning) in order to allow suffi- <br /> cient time to process final zoning solution for the property before <br /> Planning ~ommission and City"Coun~l ............ <br /> <br /> Mayor Reid declared the public hearing open. <br /> <br />Mr. Edgar reported that he, Mayor Reid, the R.F.D. Committee and repre- <br />sentatives from Castlewood Enterprises had been working together to <br />arrive at a solution to the Foothill Road zoning. <br /> <br />Mayor Reid read his statement, dated October 4, 1971, regarding this <br />solution which reported that the following proposal has been agreed <br />upon by both the property owners and the interested persons involved <br />in this issue: <br /> <br /> 1. The property be zoned R-1 10,000 <br /> <br /> 2. The precise zoning be overlayed with the R-O District which pro- <br /> vides: <br /> <br /> a. Average lot size of 12,000 square feet <br /> b. Density of 2.8 <br /> c. Side yards of 23 feet total with 18 feet on one side <br /> <br /> 3. The finding that multiple zoning would not be permitted' on the <br /> p rope rty. <br /> <br />Mayor Reid also recommended that the City Council take the following <br />action: <br /> <br /> 1. Refer this matter to the Planning Commission with the instruct- <br /> ion that the Planning Commission recommend to the City Council <br /> that the property be rezoned in accordance with the above <br /> proposal. <br /> <br /> 2. Extend the Study District for this property to November 8, 1971. <br /> <br /> 3. Process this application in time to allow adoption of an ordin- <br /> ance on November 8, 1971. <br /> <br />Mr. Russell Roessler, attorney for Castlewood Enterprises, stated that <br />he and Mr. Ebert were not under the impression when they left the meet- <br />ing with Mr. Edgar, the Mayor, and other interested parties, that any <br />agreement to this matter had been reached. He said that the conditions <br />cited by Mayor Reid would be explored, but Castlewood Enterprises was <br />not in agreement with this and that a Tentative Site Plan to develop <br />part of the property has been filed with the City. Mr. Roessler fur- <br />ther stated that 2.8 units per acre was no compromise and that he is <br />reserving Castlewood Enterprises' right to resort to any legal action <br />they might have but they do not agree to this proposal. <br /> <br />Mr. Ed McDonald, chairman of the R.F.D. Committee, who was present at <br />the negotiations, stated that it was his understanding that the pro- <br />posal was agreeable with Mr. Roessler. <br /> <br />After considerable disc,~sion on this matter, Councilman Spiliotopoulos <br />and Councilman Beratlis stated that they were not prepared to vote on <br />Mayor° Reid's proposal and asked that this issue be postponed until <br />next weeks ' meeting. <br /> <br /> 2. 10-4-71 <br /> <br /> <br />
