After further discussion on this entire matter, it was moved by Council- <br /> man Pearson and seconded by Councilman r.4ori that the City Council approve <br /> the Position Paper as outlined by the City ~4anag'er. <br /> <br /> The roll call vote was as follows: <br /> <br /> AYES: Councilmen Herlihy, Kinney, Mori, Pearson and Mayor Reid <br /> NOES: None <br /> ~AHBSENT: None <br /> <br /> REPORTS OF BOARDS AND CO~4ISSIONS <br /> Report of the Planning Commission Re: Service Station Study <br /> <br /> Mr. Castro reviewed the report on the Service Station Study, dated <br /> February 4, 1972 and also read the following action taken by the Plann- <br /> ing Commission in their Resolution No. 1168, cn F~arch 28~ 1972: <br /> <br /> 1. That service stations be reviewed and gra~'~lzec[ <~ an individual <br /> basis and only in accordance with the nee~ ~f t.~e community at <br /> the time that the application is recei~Je~], <br /> <br /> 2. That any service station which has been a]3andened for 90 days <br /> will be removed by the developer or t]~e c~!!. t ~L~o~n?~ny at their <br /> expense. If this is not done by the ~'esponsi?~le i~arties, the <br /> City will have the right to remove said ~tatlio~?, ~nd levy the <br /> cost against the builder. <br /> <br /> 3. That should another use be designated for the site after removal <br /> of said station, the procedures of the Design Review Ordinance <br /> shall be applicable to the new use and be concluded within the <br /> same 90-day period. <br /> <br /> Mayor Reid stated that he agrees that no specific formula is possible, <br /> however, the City has t~e prerogative to pre-plan areas in order to <br /> adhere to the philosophy of the General Plan~ <br /> <br /> Councilman Pearson stated that he was definitely opposed to Service <br /> Stations being located on the open corner of shopping centers as this <br /> has created a serious traffic hazzard. <br /> <br /> Mr. McNabb, representing Western Oil and Gas Association, stated that he <br />is n6t concerned with item 1 of the Planning Commission's conclusion, but <br /> he felt that the 90-day clause in item 2, displayed severe discrimination <br /> on that particular use of a Conditional Use Permit~ He felt this 90-day <br /> clause could easily be circumvented and therefore this legislation <br /> would be ineffective~ He also asked for clazjfication on item No. 3, <br /> regarding the "same 90-day period" statement. <br /> <br /> After some discussion, ~4ayor Reid asked that this enti~e matter be re- <br /> ferred back to the Planning Commission for clarification of Item No. 3 <br /> and with an amendment to Item No. 1 to read that"Service Station <br /> applications be granted only in conformance with pre-planning criteria <br /> as may be developed by the City and in specific regard to the stated <br /> policies withing the General Plan". <br /> <br /> It was moved by Councilman Pearson and seconded by Councilman Mori that <br /> this matter be referred back to the Planning Conmission for clarification <br /> on Item No. 3 and to included the amendment to item No. 1 as stated <br /> by Mayor Reid. <br /> <br /> The roll call vote was as follows: <br /> <br /> AYES: Councilmen Herlihy, Kinney, Mori, Pearson and Mayor Reid <br /> NOES: None <br /> ABSENT: None <br /> <br /> 4. 4-24-72 <br /> <br /> <br />
