PUBLIC HEARINGS <br /> <br />There were no public hearings scheduled for this meeting. <br /> <br />MATTERS CONTINUED FOR" DECISION <br /> <br />Further Discussion of AB-i_7_0 Re: ~Directly Elected Governing Body of <br />BART <br /> <br />Mr. Edgar stated that copies of AB-170 had been forwarded to the Coun- <br />cil. He explained that basically, this bill would direct the board to <br />divide into nine ~lection districts, to be as nearly equal in popula- <br />tion as possible; that the election of board members to be conducted, <br />in general, in accordance with the Uniform District Election Law; and <br />specifies procedure to adjust the boundaries of the election district <br />after each federal decennial or after an annexation to the district. <br /> <br />Mayor Reid stated that the policy of local government representatives~' <br />and the League of California Cities has been to support local represen- <br />tation of mayors and councilmen and members of the Board of Super- <br />visors through directly elected officials on these various regional <br />Boards and Commissions. This legislature, he said, would be a change <br />in that procedure or policy and that is the basis of this bill. <br /> <br />Further discussion on this matter ensued, however, no action was <br />taken. · <br /> <br />Discussion Re: letters from Vice-Mayor Spiliotopoulos and Kaiser <br />San and Gravel reg'arding Kaiser Reclamation Pro~ect <br /> <br />Councilman Spiliotopoulos reviewed his letter to Mr. Downing,. Kaiser <br />Sand and Gravel, and also Mr. Downing' s res~3o~se. <br /> <br />Mr. Corley, r~presenting Kaiser Sand and Gravel~ said the firm has <br />already spent ~20,000 on a study to determine the feasibility of this <br />reclamation project. He also advised the Council that before this' <br />project is put into operation, Kaiser will have to obtain a Condit- <br />ional Use Permit from Alameda County. He further stated that this <br />permit can be te~'.ninated at any time the fill contaminates any element. <br /> <br />Discussion ensued .'~.garding the city selecting an independent consul- <br />tant, to be paid fo',' by Kaiser, rather than acceptin9 a possibly <br />biased opinion from '.he experts retained by Kaiser to ~':nduct the <br />various tests and stu,~.es.that are neeCad in researching ~.his pro- <br />posedreclamation proje~'-~.. After a consi~erable amount of o!.~cussion <br />on all phases of this e'.tire project, inci,-.~ing the possible ~:.nex- <br />ation of Kaiser Gravel pits to the City of b,~.asanton, Mr. Edgar' was' <br />directed to combine the P',.~nning Commission c~.~ditions for the p~-~,ect <br />and the enviornmental impa'.t study into an offic.: al policy statemen~ <br />for City Oounc~l consideration at the next counci~i meeting. <br /> <br />Report of the City. Attorney Re; Results of the Court Case related to <br />SAVE <br /> <br />Mr. Hirst reported that the court has allowed that the SAVE Measure 'beI <br />placed on the ballot for the April 11, 1972 election but at the same <br />time retained jurisdiction of the law suit to allow the 'validity of <br />the ordinance to be litigated following the electio]:,, <br /> <br />SPECIAL REPORTS <br /> <br />Re. port Re: Tonnage Tax for Gravel Companies <br /> <br />Mr. Edgar reported that the staff has been conducting an investigat- <br />ion of the feasibility of establishing a limitation of gravel trucks <br />on the city streets.
