Mr. Edgar stated that it should first be determined if:the Council will require consideration of an Environmental Impact State- ment on this project. Mr. Castro presented the staff report regarding this matter and displayed a map showing the proposed changes of density on this proje~ Mr. Edward Dienstaf, Attorney representing Morris Stulsaft Trust, owners of 5 acres of the property in question, stated that this land was sold to be used for commercial purposes, creating a pattern that would be best suited to the land, or Highway-Commercial use. He further stated the Planning Commission decision acts as inverse con- demnation; that the rezoning becomes useless, and that it would not be economically feasible to develop single-family homes on this parcel~ and urged the City Council to retain the zoning as it is now on the 5 acres. Mayor Reid declared that a decision should be made at this time regarding consideration of an Environmental Impact Statement on this application. It was moved by Councilman Pearson that an Environmental Impact Statement be required on this project. The motion died for lack of a second. It was moved by Councilman Kinney, and seconded by Mayor Reid, that the above application be exempted from consideration of an Environmental Impact Statement. -3- 12/11/7~
