It was moved by Councilman Kinney, and seconded by Councilman <br /> Herlihy, that the public hearing be closed. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Mori, Pearson and Mayor Reid <br /> NOES: None <br /> ABSENT: None <br /> <br /> It was moved by Councilman Herlihy, and seconded by Councilman <br /> Kinney, that Ordinance No. 685, amending Title II, Article 2, Sec. <br />2-5.21(h) of the Ordinance Code of the City of Pleasanton to allow <br />pets other than dogs and cats in a single-family home, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlih"y, Kinney, Mori, PearSon and Mayor Reid <br />NOES: None <br />ABSENT: NOne <br /> <br />Application of the Planning Commission of the City of Pleasanton to <br />rezone from the C-F (Commercial Freeway) District to the R-1-6500F <br />(Single F.a.mily) District that parcel defined as 946-2555-1; from the <br />P~4-1500 (Multiple) District to the R-1-6500 (Single 'Fami.!y) Distric~ <br />those parcels defined as 946-2555-12,946-2555-13, 946-2555-59, 946 <br />2555-60,946-2555-61, 946-2555-62, 946-2555-63; from the RM-4000 <br />(Multiple) DiStrict to the R-1-6500 ('Single Family) District those <br />parcels defined as 946-2554-1, 946-2554-35,946-2554-92,946-2555-2~ <br />946-2555-11, 946-2555-14, 94'6-2555-48, 946-2555-49, 946-2555-50, 946- <br />2555-51, 946-2555-58; said properties generally fronting on VineyardI <br />Avenue or along the extension of Tawny Drive, as noted on the approVed <br />tentative map, 'and fu~'Eher "'application of the Planning Commission to "' <br />reclassify t[e"~'nei~hb0'rho0d shopping center fronting Pico Avenue and <br />Tawn~ Drive consisting 0~ ap. proxl.mately 14 acres, more~ o~ less, to' <br />approximately 10 acres for a commercial neighborhood shopping center <br />with the ~m..aining 4 acres, more or less, to be designated as a PUD <br />Multiple Development (RM-2500) denS. ity., said property more precisely <br />described as Parcel 946-2551-1 <br /> Mayor Reid declared the public hearing open. <br /> <br /> Mr. Edgar stated that it should first be determined if:the <br />Council will require consideration of an Environmental Impact State- <br />ment on this project. <br /> <br /> Mr. Castro presented the staff report regarding this matter and <br />displayed a map showing the proposed changes of density on this proje~ <br /> <br /> Mr. Edward Dienstaf, Attorney representing Morris Stulsaft Trust, <br />owners of 5 acres of the property in question, stated that this land <br />was sold to be used for commercial purposes, creating a pattern that <br />would be best suited to the land, or Highway-Commercial use. He <br />further stated the Planning Commission decision acts as inverse con- <br />demnation; that the rezoning becomes useless, and that it would not <br />be economically feasible to develop single-family homes on this parcel~ <br />and urged the City Council to retain the zoning as it is now on the <br />5 acres. <br /> <br /> Mayor Reid declared that a decision should be made at this time <br />regarding consideration of an Environmental Impact Statement on this <br />application. <br /> <br /> It was moved by Councilman Pearson that an Environmental Impact <br />Statement be required on this project. <br /> <br /> The motion died for lack of a second. <br /> <br /> It was moved by Councilman Kinney, and seconded by Mayor Reid, <br />that the above application be exempted from consideration of an <br />Environmental Impact Statement. <br /> <br /> -3- 12/11/7~ <br /> <br /> <br />
