Mr. Edgar Ipresented a copy of the Zone 7 Minutes. <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Report Re: Civil Suit A.~ainst Petaluma re~ardin~ Controlled Growth Ordinanc~ <br /> Mro Scheidig presented his memorandum regarding this matter, and stated that <br /> due to the City Council's interest in regard to the establishment of an ordinance <br /> regulating the number of dwelling units to be constructed annually within the City <br /> of Pleasanton, it is recommended that the Council authorize limited financial par- <br /> ticipation by the City in this suit as well as any legal assistance which may be <br /> required. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Mori, that Reso- <br /> lution No. 73-94, authorizing the City Attorney to advise the City of Petaluma <br /> of the City of Pleasanton's interest in its suit and appropriate the sum of <br /> $100~00 in support of this litigation on behalf of the City of Petaluma, be <br /> adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br /> NOES: None <br /> ABSENT: None <br /> <br /> Report Re: Sewer Claim of Mr. and Mrs. Robert Bacon <br /> Mr. Scheidig presented his report regarding this matter, stating the City has <br /> received a Claim from Mr. and Mrs. Robert Bacon, 3655 Sirrah Court, in the amount <br /> of $950000, relating to cost for sewer replacement of a line from their property <br /> to the City's main, and it is in order for the City to deny this claim. <br /> <br /> Mr. Robert Bacon, 3655 Sirrah Court, addressed the Council stating this was <br />a faulty installation and requested the award of $950.00 for damages in connection <br />with this Claim. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Herlihy, to deny <br /> the Claim of Robert and Patricia Bacon and refer the matter to the City Attorney <br /> for handling. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br />Letter from Buildin8 Code Actions. Re: Sprinkler Ordinances <br /> Mr~ Edgar presented a letter from Building Code Action, dated May 4, 1973, <br />regarding Sprinkler Ordinances. This matter is informational only, and no action <br />is required. <br /> <br />Letter from Alameda County Human Resources A~ency Welfare Dep~rtments R~: Foster <br />Family Day Care Homes <br /> Mr. Edgar presented a letter from the Welfare Department, dated May 16, 1973, <br />regarding the $75.00 Use Permit fee for Foster Family Care Homes, and requested <br />the waiving of this fee~ Mr. Edgar stated the fee for this particular type of <br />application was excessive and urged reduction of the fee. <br /> <br /> It was moved by Councilman Reid, and seconded by Councilman Kinney, that <br />Resolution No. 73-95, establishing a fee for the Use Permit related to families <br />interested in providing Day Care services to children of working parents at <br />$10.00 rather than the normal fee of $75.00, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> Mayor Pearson reported on the League of California Cities Mayors' and Council- <br />men's Legislative Conference held in Sacramento on May 14, 15, and 16, 1973. <br /> <br /> 7. 5/21/73 <br /> <br /> <br />
