Mayor Reid declared the Public Hearing, open. <br /> <br /> Mr. Stephen Chandler, 220 Juana Way, San Leandro, Attorney representing <br /> Singer Housing Company, reiterated the history of Tracts 3311 and 3312, stating <br /> that the land was acquired in 1967, and in the Annexation Agreement with the <br /> City, the property was to be zoned R-1 (Single Family Residential)~ The City <br /> has approved Tentative Map for Tract 3311 and Final Map for Trace 3312. He <br />__further stated that all the conditions of the Annexation Agreement had been met <br /> by the developer and asked the City to honor its commitment to allow the re- <br /> mainder of development of these two Tracts as residential, as he felt commercial <br /> or industrial zoning would not be compatible or harmonious. <br /> <br /> Mr. Hank Fartell, San Ramon Village Company, representing Qualified Investors, <br /> owners of Parcel #941-1302-2-19, stated his client had no particular plans for <br /> the 13 acres in question since V.CoS.D. does not need the land for future sewer <br /> expansion. He further stated considerable improvements had been made to the <br /> area~ Mro Fartell commented that either residential or commercial development <br /> could be compatible, or it could be used as open space but this would be costly <br /> to the City and taxpayers. <br /> <br /> Mrs. Anna Martinsen, 4038 Payne Road, stated she would like to see a buffer <br /> zone left as open space or park area, however, if zoned commercial it could be <br /> highly desirable if handled in good taste, and would relieve any further crowd- <br /> ing of the schools, present job opportunities, and a greater tax base. She <br /> further stated that if the area is zoned residential, there should be a require- <br /> ment that the developer inform prospective buyers of the proximity of the sewage <br /> treatment plant since F.H.A. or V.A. will not carry loans on houses built within <br /> 1,000 feet of such a facility. <br /> <br /> Mr. Juan Covian, President of the Val Vista Homeowners Association, stated <br /> that the residents of the area, after hearing the presentation by City Manager <br /> Edgar and Councilman Herlihy, were in opposition to any commercial development <br />--~n Tracts 3311 and 3312, and felt that Parcel #941-1302-2-19 should be used as <br /> a buffer zone. <br /> <br /> Mr. Covian presented a Petition which read as follows: "We, the following <br /> residents of the Val Vista Subdivision, object to the rezoning of Tract Maps <br /> 3311 and 3312 from residential to commercial usage. Over the last year we have <br /> not found the odors emitting from the sewage plant objectionable". This Peti- <br /> tion was signed by 81 residents of the Val Vista Subdivision. <br /> <br /> Mru Charles Fugel, 6485 Alvord Way, spoke in opposition of commercial or <br /> industrial development in the area, and questioned some of the odor control <br /> devices of the V.C.S.D. sewage treatment plant. <br /> <br /> Mr. Norman Bumgarner, 6370 Alvord Way, expressed his concern regarding the <br /> residents living in the perimeter area as to the buffer zone needed, traffic, <br /> and safety of school children, and stated he was against commercial zoning. <br /> <br /> Mr. Norman Marriott, 4763 Herrin Way, stated he had talked to most of the <br /> residents who live on Herrin Way, and they were in unanimous agreement in <br /> opposition to commercial development in this area. <br /> <br /> After discussion, it was moved by Councilman Kinney, and seconded by Council- <br /> man Herlihy, that the City Council express its intention that the Study District <br /> be removed from the property included in Tracts 3311 and 3312, thus permitting <br /> the outlying residential zoning to become permanent with the following conditions: <br /> <br /> 1. That all potential homeowners be made aware of the proximity of <br /> the sewage treatment plant and that this information be placed <br /> into the appropriate brochures, public reports, etc. <br /> <br /> 2o Appropriate displays reflecting the location of the sewage treat- <br /> ment plant be prominently located in the sales tract office. <br /> <br /> In addition, the City Council includedin their motion that the property included <br /> in Parcel #941-1302-2-19 be retained in the Study District, and instructed the <br /> staff to proceed with developing a recommendation regarding the ultimate use for <br /> that property with the understanding that there should be a buffer between the <br /> sewage treatment plant and the residential development. <br /> <br /> 2. 1/29/73 <br /> <br /> <br />
