Mr. Edgar presented the various staff reports regarding this matter regarding <br /> history of odors from the sewage treatment plant, land use, and the Environmental <br /> Impact Statement~ He also read a letter from Mr. Paul Ryan, General Manager, <br /> V.C.S.D., regarding the sewage treatment plant, stating that complaints on odors <br /> had decreased, however, increased use of the plant would increase sewer odors. <br /> Mr. Edgar stated the decision before the Council tonight is whether the problems <br /> with the sewer plant generally outweigh the problems with an uncommon land use. <br /> <br /> Mr. Castro reviewed the report regarding Environmental Impact Statement and <br /> land use recommendations of the area, stating that Commercial Service zoning would <br /> probably have some impact on the environment, more so than as now designated. <br /> <br /> Mr. Stephen M. Chandler, Attorney representing Singer Housing Company, stated <br /> the land had been purchased by his clients in 1967 and had planned unit develop- <br /> ment approval from the Council at the time the land was annexed, per agreement to <br /> the City. He further stated that Singer has complied with all the conditions of <br /> that approval and that Tract 3311 has an approved tentative map and Tract 3312 <br /> has an approved tentative and approved final map. Mr. Chandler requested that <br /> the City follow through with the commitments made during the annexation agreement <br /> negotiations. <br /> <br /> Mr. Ronald Pardini, Vice-President of Singer Housing Company, stated his com- <br /> pany has already expended some $25 million on the property, built 885 out of the <br /> approved 1,035 homes, donated a park, and put in streets and utilities for a resi- <br /> dential development. He stated that Singer has worked in good faith with the City <br /> and would certainly voice a very strong protest of inverse condemnation if the <br /> property was not put to a compatible use in the neighborhood. <br /> <br /> Mr. Hank Farroll, representing Qualified Investors, Inc., owners of Parcel <br /> 941-1302-2-19, presented a history of the land in question, stating they reserved <br /> this 13 acre parcel for future sale and use by V.C.S.D., for expansion of their <br /> sewage facilities. He further stated that V.C.S.D. does not intend to buy the <br /> land and he has been unable to sell it to anyone. He urged the Council to con- <br /> sider residential or a combination of compatible industry. <br /> <br /> Mr. Norman Bumgarner, 6370 Alvord Way, stated his concern regarding the resi- <br /> dents in the perimeter of this area should industry be allowed and urged careful <br /> consideration of this matter by the Planning Commission and City Council. <br /> <br /> There was general discussion regarding sewer odor problems, industry locating <br /> next to existing residential, and increased traffic. <br /> <br /> It was moved by Councilman Pearson, and seconded by Councilman Mori, that the <br /> public hearing on this matter be continued until January 29, 1973. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Herlihy, Kinney, Mori, Pearson, and Mayor Reid <br /> NOES: None <br /> ABSENT: None <br /> <br /> It was moved by Councilman Pearson, and seconded by Councilman Herlihy, that <br /> it was the intention of the City Council to rezone Maps 3311 and 3312, and Parcel <br /> Map 941-1302-2-19 to land uses other than residential and in accordance with those <br /> land uses designated in the staff report dated September 19, 1972, from the Di- <br />._ rector of Community Development. <br /> The roll call vote was as follows: <br /> AYES: Councilman Pearson <br /> NOES: Councilmen Herlihy, Kinney, Mori, and Mayor Reid <br /> <br /> Mayor Reid reiterated that there had not been enough testimony from residents <br /> in the area, and he did not want to be restricted by a Resolution of Intention <br /> regarding a decision on this matter. <br /> <br /> Councilman Mori requested a policy regarding FHA on this land. <br /> <br /> 2. 1/15/73 <br /> <br /> <br />
