PUBLIC HEARINGS <br />Appeal of J. A. 3enks Compan7 from a decision o£ the Director of Community Develop- <br />ment r.equ. i..rin~ that said applicant pFepare an Environmental Impact Repor~ for. a <br />project located on the Northeast corner of Mohr Avenue and Oakland Avenue <br /> Mayor Pearson declared the public hearing open. <br /> <br /> Mr. Edgar presented the staff report regarding this matter, stating that the <br />reason for requiring an Environmental Impact Report is because of a discrepancy <br />between the General Plan and the Zoning Ordinance. <br /> <br /> Mr. Harris, Senior Planner, stated that if the plant is constructed and the <br />General Plan is followed on the rest of the land in that area, it would mean that <br />the Jenks plant would be the only industrial use east of the railroad tracks and <br />north of Mohr Avenue and it would be surrounded on the north and east by expensive <br />single family residences, thereby creating the possibility of a land use conflict <br />at some point in the future. He further stated that this area of the General Plan <br />would have to be brought into conformance with the Zoning Ordinance by January 1st <br />according to State Law. <br /> <br /> Mro Pat Gill, 6599 Stanton Court, representing J. At Jenks Company, stated his <br />firm had been working on this project for the past four years. He stated the type <br />of development is a seasoning company that blends essential oils in concentrated <br />seasonings~ This constitutes 50% of the plant, the balance being used as a ware- <br />house. Mr. Gill added that his architect says that an Environmental Impact Report <br />is superficial since there is no grinding of spices or dust element involved. He <br />further stated that an Environmental Impact Report requires time and money, and <br />he urged the Council to give favorable consideration to his appeal. <br /> <br /> No one in the audience spoke in favor or against this appeal. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Reid, that the <br />public hearing on this matter be closed. <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, Reid, and Mayor Pearson <br />NOES: None <br />ABSENT: None <br /> <br /> Councilman Kinney commented that development of this kind should be encouraged <br />and he did not feel that an Environmental Impact Report was neccesary for the pro- <br />Ject. <br /> <br /> Mayor Pearson stated that he was in favor o~ requiring an Environmental Impact <br />Statement on this application because of the long range implications on this area. <br /> <br /> It was moved by Councilman Kinney, and seconded by Councilman Reid, that Reso- <br />lution No. 73-122, upholding the appeal of 3. A. Jenks Company from a decision of <br />the Director of Community Development requiring that said applicant prepare an <br />Environmental Impact Report for a project located on the Northeast corner of Mohr <br />Avenue and Oakland Avenue, be adopted, and instructing the staff to make a study <br />of the planning area north of Mohr Avenue~ <br />The roll call vote was as follows: <br />AYES: Councilmen Herlihy, Kinney, Mori, and Reid <br />NOES: Mayor Pearson <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />Further Re.port of the ~ss.i.s=a~.~. Policies <br />..(.Septic Tank and Holdin~ Tank) <br /> Mr. Campbell presented hie staff report stating that with respect to the use of <br />holding tanks, the staff has no objections to the use of holding tanks as an interim <br />or even in some cases a permanent solution for commercial or industrial uses in any <br />location provided they are properly constructed and serviced~ adding that the only <br />reservations would pertain to large installations or large concentrations of indivi- <br />dual facilities where the number of truck trips necessary for servicing might cause <br />problems, or locations where the truck routes might be objectionable. Under the <br />proper conditions a holding tank for commercial or industrial uses could continue <br />indefinitely without detriment to the City, the public or the environment. He <br />further stated it has always been the feeling of the staff that holding tanks are <br />not a good solution for residential uses simply because of the increased difficulty <br />of control and because as a practical matter it is virtually impossible to stop <br />the waste discharge if something goes wrong. <br /> <br /> 2. 7/16/73 <br /> <br /> <br />
