Mayor Mori declared the public hearing open. Mr. Joe FoSs, 446 Arlington CoUrt, stated the two Bantam hens were pets and cared for in that manner. CaDt. E. D. Chester, Jr., 528 Hamilton Way, whose property is adjacent ~o Mr. Foss, expressed opposition to this application because of the noise nuisance created by the chickens as well as drawing flies to his swimming pool area. Mayor Mori declared the public hearing closed. It was moved by Councilman Philcox, and seconded by Councilwoman LeClaire, that Resolution No. 74-128, approving the appeal of Joe Foss, 446 Arlington Court, of the Planning Commission decision denying application for a Conditional Use Permit to allow the keeping of two chickens on his property, subject to the con- ditions set forth in the staff report, be adopted. After discussion, it was moved by Councilman Kinney, and seconded by Council- woman LeClaire, that Resolution No. 74-129, authorizing removal of the following Heritage Trees or Street Trees: (1) One 30-inch diameter Poplar tree and one 18- inch diameter Locust tree from the School District office site at 123 Main Street; (2) One lO-inch diameter Acacia tree from public right-of-way at 123 Main Street; (3) One 12-inch diameter Camphor tree from public right-of-way at 4371 Second Street; (4) One 36-inch diameter Hackberry tree from public right-of-way at 148 Ray Street; (5) One 30-inch diameter English Walnut tree from public right-of-way at 4837 Black Avenue; (6) One 24-inch diameter Acacia tree from the west side of Amador Valley Community Park; and (7) One 26-inch diameter Pine tree in the front yard of 943 Rose Avenue,be adopted.
